What if I can not afford the full payment they request of 350.00 and can only send in 250.00 each month.?
Are they quick to default you and sue ya and hang you?
I am applying for the low income sensitive payment--but if I am not approved of that, then I worry they will try to hang me and then my life will end as I know it.
Where is Jedi by the way...?? have not seen her around her very much.

if you cannot afford it, the best thing to do is to get in tuch with them and explain it to them. Do NOT try to run or hide.
Just call them up and talk to them and if the person is being rude, then hang up and call some other time.
all they want is their money and usually, they will try to work with you to get it. just make sure you dont let them dupe you into some more interest charges or stuff like that.

Linda, the most important thing is that you are taking the responsibility and pay off the debt. Be it in partial payments only. They will hardly have a case to file in the court. If they do, the judge will see you taking care of the account and hence rule out the case.

I'm here Linda, I've just been a very tired Jedi lately with very little on the mind. My apologies.
Were you given a student loan pre-application quiz? If you, you will remember that the minimum acceptable monthly payment on a current student loan is $50. As long as you remain current, and your intentions are there, your lenders will work with you.
It takes sixty days of nonpayment for a student loan to be considered defaulted. If you default, you do have options still, but not as many. If your defaulted student loan falls into the hands of CCA or NCI, it will be in good hands, and you really should play ball with these two particular CA's because they follow the rules and are just.
Quick to sue? NO! I've seen loans in default since I was in utero, and the account never litigated. The Department of Education will not litigate unless your defaulted loan is at least five figures, and you have numerous resources for payoff at your disposal, but you just refuse.
I start my student loan repayment in early 2007 myself. We'll be together on that!

Even since your loan is 48k, what would qualify your loan for litigation, should you default it and refuse to pay, would be if your credit report showed mucho assets at your disposal. If that is not the case, don't worry.
You are not in default! You are not screwed until you really make them mad by going into default and refusing to pay. I've even seen six figure default loans never litigated because the debtor had no assets and no job!
You'll be fine. Just talk to your lenders/consolidators/whoever about your situation, what you can pay, and this will work out!

Thanks...Jedi.
Now, I will worry about my student loans at that time. Right now I am worried about my settlement company I am enrolled in and the 8 cards I have in the program with them. I am terrified they will try to sue me. I am hoping that should it come to court, that the Judge will favor me since I am enrolled in a debt settlement company.

He will. If you skip court, that is when the judge will find in favor of them. Enrolling in a settlement shows good faith. Besides, you can have the settlement company send cease and desist letters to those creditors or collection agencies. You can also have the settlement company speak for you.
