Help!!! need to know the law
Needs to know the law.
Hello Christina,
Welcome to the forums.
There is no such law where, one cannot disclose his/her credit information to their family members.
However, if a collection agency is trying to contact you or your family about debts that you owe, then there are certain laws restricting the collectors from talking to your family members.
The Fair Debt Collections Practice Act [Code#805(b)] states that, a debt collector cannot contact anyone except the consumer (debtor), his attorney, or a consumer-reporting agency, unless:
i) The consumer has given the debt collector prior permission to contact anyone else;
ii) The collector has received permission from any court of competent jurisdiction;
iii) There is any reasonable cause to call a consumer's family, in order to put a post-judgment judicial remedy to practice;
iv) Unless the debtor's attorney or creditor's attorney permits the collector to contact any other family member, they cannot contact them.
Otherwise, a collection agency cannot talk to any other family member, except the consumer himself about debts that he owes to anyone (collection agency/creditor).
