Debt Collectors Leaving Messages at work on operator number

I am having one particular debt collector leaving a message on the general mailbox for the company and then getting hand written notes from the receptionist. They know my extension - is what they are doing illegal?

Hi scottvin

Welcome to the forums. The collection agencies are using unfair and illegal methods to contact you. You can only protect yourself and keep your sanity when you are aware of your rights under the Fair Debt Collection Practices Act.

Please mention if you are having any debts in the past which this collection agency is trying to recover. If you believe that your debt is invalid, inaccurate or does not belong to you, you can protect your rights under the fdcpa by placing this account in "Disputed Status"

Following precautionary measures can be applied while dealing with the collection agents.
[list=1]

  • Please keep accurate records of all the correspondence used by the debt collectors along with the dispute letters. You can also tape record all the conversations of the debt collectors and inform them of your action.

  • Please make sure that you get intimidated by their unfair threats. You have your legal rights.

  • Please get everything in writing while dealing with the collection agents.

  • While making payments, you should not get oppressed due to the threats of the collectors.

  • Always report if the collection agents are using abusive language or illegal harassments.

  • Please try to avoid payments through post dated checks or automatic withdrawals

  • Please don't get bullied by the actions of the collection agents during your payments.

Please let us know your approach to it. Your active participation in the forums will be appreciable.

    Hello scottvin,
    Welcome to the forums.

I read your post scottvin, and I believe you are facing illegal and unfair methods of collection by an agency. You can protect yourself from such harassment as the federal law (fdcpa) has specifically laid down the rules as to what a collection agency can or cannot do. To know more about your rights concerning collection of debts, you can read the related article, by viewing this page:

If however, you do have some unpaid debts, it will be wise to pay them as soon as possible, as this may have a bad impact on your credit reports.

    Hope this information helped you.
    Keep posting in.

    Regards,
    Peter
