harrassing collectors


about a month ago, I got a phone call from a collection agency. My brother answered the phone and spoke with the rep. When the rep asked who he was speaking with, my brother responded with the same question. The rep answered with a Mr.x ...so my brother replyied with ok I am Mr Smith. The rep went on to discuss my acct with my brother....when I did get the phone, I immediatly asked the rep to tell me the purpose of the call, he asked me if I misunderstood something he said. I told him I didnt hear anything he said because that wasnt me on the phone a minute ago. I asked to speak with his supervisor, at first he said he didnt have one. I got the reps name. I asked again for a supervisor...he told me to wait. He came back about a minute later, muffling his voice, pretending to be his supervisor!!
He then hung up when I called him on it. I called back and eventually got what I believe was a supervisor. I explained the situation, was told there was nothing they can do about it. my word against the reps.
Well that leads us to today. I got a phone call this morning, and no message was left. when I called the number back, I found out that it is the same company that I mentioned above. I immediatley asked for a supervisor again. the rep asked why, I told her that this account was supposed to be stricken from my records due to info being devulged...she literally laughed in my ear, and hung up. I called back and spoke with a supervisor again, I was again told there was nothing he or his company can do.....

Welcome to the forums. It seems that the harassment of the collectors is increasing at a faster pace. As per the fdcpa laws, the collectors are imposed certain restrictions and they cannot harass anyone for recovering debt. Please send one written notice stating that you do not wish to interact with them. If they are trying to recover any debt, please ask them to validate it as you have every right to know the origin of the debt lawfully.

I read your query; it reminds us of how the collection agencies' harassment is going out of hand.

You must be aware of the federal law, the Fair Debt Collection Practices Act. This act lays down the procedures about the way a debt collector should operate. There are legal limits to what a debt collector can do or say. Perhaps, some debtors like you are still not fully aware of it.
