Collection Agency


Our creit card just got turned over to a collection agency and they will not do payment agrangement w/ us- they want it all in one payent ALSO they are callen family and freinds and bothering them and getting info - is this legal ?

Welcome to the forums. I read your post and certainly feel that the collection agency is breaking every law to recover the debt. Please don't worry much as the law is at your side and you can take their help. First of all, please write one written notice to them stating that you are not interested to entertain their calls and they should stop collecting information by unfair means. According to the fdcpa law, the collector should immediately stop themselves from calling you further by any means once they receive your written notice. If he needs to recover the debt, he has to get in touch with your attorney and ask for an appointment before calling you or meeting you in person.

If the collector still does not follow it seriously, then you have the right to file a case against them and sue for a maximum amount of $1000 from the day the law is broken.
