Is a company licenced???
I took out a pay day loan with a company in Ontario and they operated under a specific name. I am in the process of fighting with them because they are trying to charge me a different amount. The documents they are sending to me have a different company name though then the one I had initally signed with - I initially signed with Yellow Cash Store and the documents I am receiving state the name as Consolidated Financial.
If they file court documents am I to presume that the court wouldn't let them unless they were licenced or would they not care either way?
Any advice would be very appreciated.

You initially signed with Yellow Cash Store. I think you have one copy document of that. So you don't have to worry about that. You are taking the right decision to fight against the company as they are charging higher amount.
You can go to the consumer protection department for the details of the company, they may help you to know whether they are licensed or not.

I have moved since dealing with Yellow Cash Store so I was not receiving any documentation until two weeks ago when court documents were faxed to my company and three different people had seen them here and brought them to me. Apparently, they went to court and filed a claim "Notice of Default" and now they demanding my payroll department to garnish my wages by court order. They had verbally harrassed my payroll administrator yesterday and then verbally harrassed me when I called them. I wanted to work out a payment plan but they told me "angrily" that it was too late and they have spent money on filing these claims with the court. I owed $502.00 now apparently they are telling me I owe them $1,065.00! I contacted their head office in Vancouver and although she was a nice enough lady to deal with she told me that they person would be written up about the harrassment but wasn't anything she could as it has already gone to the courts - she couldn't work out a payment plan with me. I tried dealing with Yellow Cash Store and basically was verbally harrassed in return. The head office is telling me that the garnishment has to go through unless I want to file a motion and pay court costs. I don't know to what advantage me going down to the court office is in Toronto but I feel I am being ripped off here for double the amount when initally I wanted to work out a payment plan. The lady at head office said a payment plan could have been worked out but not now. The rude gentleman is telling me that if my payroll department does not pay, my company could be in legal trouble which I DON'T want - I feel I am getting screwed here - there has to be a way to fight this or at least lower the costs to the amount I owe and pay them directly for it - I can't afford a lawyer and I am not sure that the courts are allowed to give advice. I had already contacted them and they told me I had 20 days to file a motion but I never received the documents and the 20 days have now passed. I tried to work it out with them but he took it upon himself to go to the courts. His head office couldn't believe he did that.

While I know nothing about Canadian law, I'm pretty sure they are not allowed to profit on filing in the courts. Call the court and ask them what fees would have been charged and see if it adds up. What ever you do, do not let it go to court without responding and getting a judjudgment default. You must show up and present you side of the story. If they are trying to profit (by adding cost beyond what the actual courts costs are) you can bring this out in court, which I am sure the judge will take into account. Show you are willing to work out an arrangement, and the judge will also take that into account. Even if they get a judgment they will be forced onto a payment plan anyway, so make them jump through hoops now too. They started the game, make them play it.
