ID1,

Excel Acquisition is a collection agency. Probably any of your debts has been transferred to them; hence they are appearing in your credit report. You may like to contact them and ask for clarification. If they agree that they are holding your account, request debt validation first.

Debt Validation is the first step of debt collection process. They should return you an itemized detail of your accounts. If you find any discrepancy in the validation, you can dispute it within 30 days as well.

P.S. If you are sure that this item has been entered wrongly in your report, you should dispute it. Send dispute letter through certified mail with return receipt requested.

Same thing is happening to me. Same company, Excel Acquisitions LLC. Suddenly a debt
appears on my credit report and I have never had the card it states
or any prior notification of a debt. Something is
very wrong and I plan to investigate a bit.
Do you have any additional info??

Kat

Dispute the item with the credit bureau reporting it. Highlight it and the bureau will verify the account with your information providers. If they say the item has been verified, ask them to give out the results of their investigation. You should get all the info about this item if it stays in your file.

To everyone that reads this check with consumers affairs that this company is allowed to collect debts in your state with consumers affairs I check for New York and they have no license on file

I received a letter from this company on Jan 13,2007 they stated I had an account with Providian which was paid off atleast thats what providian told me in 2001. Now they have me owing over 4000.00. They ststed the give you 30 days to respond. Due to the fact I have credit alert; I received an alert that they added it to my account as unpaid and the date is as of january 1,2007. I wrote a letter for validation but there is no physical address on file to send a certified letter. I need proof that I sent this letter to them.
I tried to contact Providian and they stated they had no account on file for me.
What rights do I have to fight against them Please help. they are destroying my credit report

I have their physical address but it may not do any good because they are returning mail to sender. I know that it is current unless they moved within the last 3 weeks because they accepted my first VOD letter but sent back my second. I sent the second because they could not or did not provide any info besides Providian's name and address. here is the address.

I just recieved a letter in the mail from Excel, I called them and was put on hold and then was told someone would contact me, no one did, so I called again, and spoke to Scott, who was very rude in demanding money, but he could not tell me what the bill was on, he changed his story several times, so common sense tells me he was just guessing, and then he told me he didn't have the information, that we know we owed the money and we needed to pay it now over the phone, I told him I was not paying on something that I didn't owe, he was quite ugley on the phone so I hung up. I called back to speak to a manager and was connected to Tom, who was just as uniformative and sarcastic as Scott, so from there I ran a credit report on myself and low and behold Excel Acquisitions was on there inquiring information, this all happened today and I plan to fight back, does anyone have any hints, this site was helpful but the advertising on this page has cut everything off. Help!

Hi Jackie

In my opinion you should send the Excel Acquisitions a debt validation letter within 30 days of their first contact. If the request for validation is sent after the 30 days when the collection agency first contacted you, then the collector can continue with the collection activities. So, immediately send a validation letter asking them to validate the debt.

I had an account with Providian and they forwarded it to Excel and i went on a payment plan. Well I got the final 2 payments settled to be cleared completely this July, 2007. They were to withdraw the amount on July 10th I knew I wouldnt have it so I called immediately to get the date changed to the 15th when my money would be. The accounting dept gave the okay. Well guess what they took it on the 10th anyway. And my bank hit me with overdraft. I was not aware at that point I deposited my money into my account to see the remaining balance and figured out what happened, then I thought okay I still have xx amount in the bank. Oh no..paid other bills and got hit with a fee for each one. I called them and they said discuss it with your bank. So their error has now cost me several dollars in overdraft and now i have to file a check fraud claim. Who needs this drama.

Well i had a providian account at least back to 1999 or so. Had a max limit of 200 dollars on a BMG visa card that i had paid off. Providian never contacted me about being overdue on any funds. So yesterday i got a call from the sheriff in Hays kansas telling me i had a letter from providian. I picked it up and it is a court summons to appear on March 26th of this year. They say i owe 571.70 plus 684.13 interest from the date of their last payment from me march 5th 2002. This is the only thing i have ever gotten from these people, no correspondence at all, EVER. I call providian enter in my account number from the card that they list on the paper, and there is no record of me on file. My last activity date according to the records was march 5th 2002, which is totally incorrect considering providian never called me saying i owed any money. I also pulled my credit report and there is nothing to do with Providian anywhere on my statement, but this excel acqusitions is on 1 of the 3, experian. The lawyer they hired is out of missouri, Berman, DeLeve, Kuchan & Chapman, LC
The address to Excel is P.O. Box 1965, North Falmouth MA 02556. What do i do?

Excel is suing me for a 12 year old account. The public record of this is ruining my credit and may force me into bankrupcy. I'm sure they're aware that it's past the statute of limitations. Can I sue them (counter-suit) for ruining my credit without any validation?

Chedmardo....what state do you live in? When was the last time you paid on the account? Is this being reported on your credit reports? Is the OC and Excel reporting? How is the public record reporting? You state you are being sued but the only public record that would effect your score is a judgement. Have they already sued and been awarded a judgement?

I decided not deal with them an go straight to the credit reporting agency an diputed it i told them to do a thorough investigation not that simple things they was doing. I asked them to have the company show the signature where I bought this item with them an they could not prove it. so and i sent proof. I called an it has been removed from my file

Dispute it, depending on the state you live in, it's most likely out of SOL anyway, and that is a good reason to dispute it.

I worked in Collections for over ten years and I know that in regards to the Status of Limitations, it begins from the last possible activity on the account, which means they can start counting from the very last late fee or interest amount and according to the law it's not illegal. In the CC agreement that everyone signs there are concessions for such things. Even if you "pay off" the principle on an account you are still liable for the interest and late fees that added up on the account, and they keep accuring until those are paid off.
Just because an account is listed as Charge off on your credit, you will still accure late fees and interest.
Until they change the laws (which some states have) there is really nothing you can do about it. Sorry!
