Getting credit 120 days before chp13
No, No, No.....don't do that.
No, No, No.....don't do that. If your wife needs a new laptop, then put it on layaway, since a lot of stores are doing layaway right now for Christmas. Do not use a card or try to get more credit. Bad, bad idea. Good luck
Disclosure
You will have to disclose anything bought on credit or contract with in a certain period of time before you file.. The time period varies by state, but I think is generally 120-180 days. It could be considered fraud if it is determined by the trustee that you purchased anything on credit knowing you intended to file bankruptcy. When I filed my chapter 13 it was is in response to a lawsuit filed by HFC who held a line of credit against a home we no longer owned. Because we didn't know this lawsuit was coming our way (and we had been trying to get caught up) we had signed a lease to own agreement for a washer/dryer. About a month later we got served with the papers from HFC. when we talked to our lawyer and at the creditors meeting it raised a lot of questions about fraudulent intent. because we had no knowledge of the impending suit which spured our filing it wasn't a big issue, and that was the first bill that was paid when the trustee started making payments.
