Can a debtor decide which debts to include in bankruptcy filing in case of a Chapter 13 bankruptcy?


Basically, debtor has to list all his assets and debts in a bankruptcy. But, a bankruptcy trustee assesses all your financial documents and decides which debts are to be discharged in a bankruptcy.

I agree with Phill, in any type of bankruptcy filing, a debtor must include all of his debts. You don't have any luck to hold back a debt, such as a loan taken from your brother or business partner.
