Will a person filing a bankruptcy get discharge automatically?


Is there any guarantee that a debtor will get bankruptcy discharge if he files for bankruptcy? My friend told me this but I couldn't believe this completely. Then what is the purpose of filing a bankruptcy?


There is no guarantee that a debtor will get bankruptcy discharge after filing bankruptcy. A bankruptcy case can be dismissed due to various reasons:

1. The debtor has not listed all his assets and liabilities properly
2. The debtor has committed a bankruptcy fraud
3. The debtor has not passed the means test
4. The debtor has not paid the court fees
5. The debtor has not submitted all the documents
6. The debtor has not completed the mandatory education course
