Can I file Chapter 13 bankruptcy to stop support lien?


My ex-spouse is threatening to impose a lien on my home for child support. I really want to avoid it. Previously, I was earning well. But now, my monthly income has also decreased. Plus, I have debts to consider. What to do. Can I file Chapter 13 to avoid it


How much do you owe to your creditors? How much debt do you have? You can't file Chapter 13 for a small debt amount. As far as your original question is concerned, yes, you can file Chapter 13 bankruptcy to avoid a support lien. You won't get this protection in Chapter 7 bankruptcy.

Yes, you can certainly file for Chapter 13 bankruptcy to avoid a support lien. As sanderspatricia29 said, I would advice you to consult a good attorney to review your situation from a legal perspective.

Without filing the bankruptcy, you may schedule a hearing before a judge. You must claim that you are already suffering from low income issues and the lien will impair your ability to pay your current support. Make that very clear to the judge. You’ll need to provide supporting documents to as proof..
