I do have another question. My friend has a loan from Western Sky. It was then transferred to Cash Call. It is a $10,000 loan. She has already paid $4600 and they say the loan balance is $10700. Is there a way for her to get out of this? I have read arguments both ways. Any success stories? Tips? Anything? I read a letter that they sent after somebody tried to say they were only paying principal. Western Sky, actually cash call, said the contract said that they were bound by reservation rules, blah blah and so they still had to pay. What would your answer be to that? Please help!


The Fort Laramie Treaty, 15 Stat. 635, between the United States and the tribes of the Sioux Nation, ???created the ???Great Reservation??? for the Sioux and set off lands ???for the absolute and undisturbed use and occupation of the Indians.??? ??? Calhoon v. Sell, 71 F.Supp.2d 990, 999 (D.S.D.199(guoting 15 Stat. 635) .FN8 Under the treaty, States may not ???interfere with reservation self-government??? or tax on-reservation activities. Rice, 463 U . S. at 718. This gives tribes the power to regulate ???the activities of nonmembers who enter consensual relationships with the tribe or its members, through commercial dealing, contracts, leases, or other arrangements,??? but only when the ???non-Indians [are] on their reservations.??? Id. at 565.FN9

Tribal law only applies if you live on their reservation. They have to abide by your state laws. Cash Call is a tough one to deal with. It is going to take a lot of work and persistence.
