i filed chapter 7 bankruptcy over 2 years ago my lender would not re affirm my first or second mortgage but i have continued to live in the house and make pmts, the house is worth approx 120 i owe 148. my question is if i walk away will this in any way affect my credit since we didnt re affirm? thx


This might be a very dumb thing to say but if your lender did not approve the reaffirmation and you (assuming) did not include the loan in your BK filing and continued to stay on the property while still carrying on with the payments...it just sounds really very mixed up. I am a little confused. Lets see if the experts can give us a good solid take on this.

Just a suggestion, but I would start with trying to get something from the bank or lender that holds the mortgages stating if they were in fact discharged in the BK, in writing. If they were you can continue to pay but they will not report your payments to the credit reporting agencies.

If the loans have already been reported as discharged then the damage has already happened to your credit.
