I am out of town but was told that someone came to my house wanting to serve papers. I was unaware of the case until today when a letter from an attorney wanting to represent me arrived, my friend forwarded me the letter. I looked up the case number on the letter and the lawsuit was filed November 7th. Who do I contact, the clerk of the court or the attorney representing FIA Card Services? I have a letter from BOA relieving me of the HELOC debt, if that is what this is about.

You contact both. Check in with the county clerk and see when you need to appear in court. Contact the FIA attorney and see if you can reach a settlement or something.
FIA only deals with credit card debts for BofA so the HELOC should not come into the picture.
