Hello,

I am in a bit of a mess. I have been paying my mortgage late within 30 days for the past 6 months. I did a stupid thing of taking out several payday loans and a Western Skye/Cash Call loan for $2500.00 I had to end up closing my bank account to stop the pdls because I had a big car expense and could not keep up with all my payments. This past mortgage payment was almost 45 days late, I had advised my credit union that the payment was going to be late and in fact always email them even when it is 30 days late. I am going to have pay the 45 days again but I know I cannot go on doing this forever. I do not want the credti union to start foreclosure procedings. Can they do that after just 45 days? I plan on notifying them that I will at least get it back to within paying within the same month for the October 1 payment. Naturally all the pdls and Western Sky will have to wait until I can catch up with my mortgage. Any advice would be appreciated.

Western sky is an illegal lender. You owe only principal - work it out on your own terms. Who are your other lenders, and what state do you live in?

As for the mortgage, I'd honestly be surprised if they foreclosed on you for a 45 day late. I would go into the branch and tell them that on October 1st, you will bring the entire mortgage current.

Thanks for your feedback. Western Sky acutally sold my loan to cash call which I think is a legal lender. Amazing how they know to get around the loopholes. I'm not too worried about cash call. They keep sending me emails telling them to call and work something out. I acutally send them half my payment and will send the other half at the end of the month. I will not be able to send them anything when I catch up with my mortgage. By the way, I live in New York. I had Payloans with Star Cash Processing, took a $500.00 loan and paid them $250.00 in principal payments, so I am sure with the rollovers I've already reached the $500.00. EZpayday cash, borrowed $450.00, paid 1 payment of $185.00, OPD Solutions, paid several rollover fees, and owed $250. principal. OPD sent the loan to a debt collection called National Processing of America. I also had a loan with ItS my Payday. They always just kept refinancing my loan before I paid it off. The last principal balance left for Its my payday was $900. Since they had a mailing address, I sent them a money order for $50.00.

As far as my mortge goes, my credit union inundates me with robo calls and voicemails whenever I go past 15 days late, no matter how much I let them know when I am paying but I agree that I do not think they would try and foreclose for just 30 or 45 days late at the most as long as I pay the interest charges.

Doesn't matter. The original loan was illegal. You only have to pay them back whatever they deposited into your account. CashCall knows this. Don't let them feed you their line of BS.

Payday loans are illegal in NY.

All of these are illegal. I wouldn't pay any of them another penny. And, if you've paid more than what they deposited, ask for a refund.
