Which State's satute of limitation do I need to review? The current state of residency, or the state where I originally acquired the Emerge Master Card


It depends.
Are you being sued? Are you asking because you received a collection letter at the old or new address?
How long ago did you move?

What state you lived in.
What state you live in now and for how long.
Who is trying to collect on the account.
What efforts and communications you have had with who is collecting.

Not sure if I'm being sued. Did my credit report finally and saw an account with Midland Fund...original Crerditor: Emerge MasterCard...Collection Account...Account information disputed by Consumer...they had confused my Brother with Me...states reported Feb 12...opened May 07...Hi Credit $759...Balance $806...just states collection at the end of report...didn't see anything pertaining to 2012, so I'm not sure if the SOL has expired. I'm currently living in Texas, and had gotten the card in 2002 in California...

When did you last make a payment on the card? Count four years forward.

The SOL on an unpaid credit card debt is typically a concern when determining if you can legitimately be sued for the debt.

There is a negative credit reporting shelf life of 7.5 years from date of last payment. Be sure to monitor that Midland did not reage the account on your credit report to reflect any date more recent than when you first fell behind.
