Unauthorized payday loans

Issue #1

Hello, a few months ago I looked for info online about possibly getting a loan for around $100 for gas until I got paid the next week. I filled out a form with my info in order to receive information from loan companies.

About two weeks later, my account was overdrawn and I checked with my bank and a company called Hydra Fund had withdrawn $90 from my account. They had apparently deposited $150 on the previous friday. It was pretty easy to miss since I got my bonus from work on the same day and I don't get a paystub mailed to me.

I immediately closed my account and opened a new one. This company
never even attempted to contact me about this, however I recently started getting calls from a supposed law firm, (Can't remember the name at the moment) claiming that I need to contact them about several criminal charges filed against me. I called, and they informed me that I owe them around $2,500 including fees and interest. I informed them that I will not pay that amount to them ever. They then threatened that someone would be at my house within the half hour and that they would take my car. I continued to explain what happened thinking this is a real law firm and continuously was interrupted. Finally I had to tell the person to shut up and listen while I finished. He then called me rude and and ignorant little f*ck. Yes I was a bit rude. But that was completely unprofessional. I am now convinced that this is not a real law firm.

Issue #2

There is another company that was calling my work about a year ago. Maybe even more. They are called CashNetUSA and they also claim that I took a loan out with them, which I did not. I am not sure if they did in fact deposite any money or not. I will have to contact my bank about it. However, they claim to have lent me $300. I had to close my bank account around the same time due to identity theft. Someone was charging my account for things I had not purchased. And at one point, I was overdrawn for over $300. The bank investigated, and found that I was not at fault and paid back all the money that was taken out and removed all overdraft fees.

There is now a supposed lawyer from CDR Associates calling me every single day. I spoke with someone from there and they claim that I owe over $2,000 after fees and everything and threatened to sue me. I explained that I had never even heard of the company and that I had told the company the same thing. I also explained that payday loans are illegal in my state and he said that it was only illegal to take them out and that I would get in trouble for that. Which I never did in the first place!

I have looked into Hydra Fund and found they have an F rating with the BBB and that they have over 500 complaints filed against them. I looked in CashNetUSA and found several things. Also looked into CDR Associates. Only legitimate organizations I found were a Medical billing law firm, and a non-profit organization. I also found that the FBI had recently done a raid on a company called CDR and associates. That is all I could find.

I told them that if they call me or contact me in any way again I will call the police and have a notice of harrassment filed against them. Then hung up.

What do I do? I never authorized any loan at all and now I'm being threatened like this?

If you don't feel like reading all that, I'll just give a quick summary here.

Issue: Online Payday loan companies threatening me when I never tried to take out, or authorized any loan from them in the first place.

Companies: CashNetUSA and Hydra Fund

State: Maine

Did you read what you signed? You signed a prom note/loan agreement with what sounds like a pay day loan broker.

Sounds like you need to start paying better attention to your account. You would have been overdrawn sooner if the Hydra Fund money wasnt there.

ya think?? For starters, debts are civil, not criminal. No one is coming. You need to stay off the phone. Hydra is an illegal offshore lender...you owe them principal only another $60

CashNetUSA is a legal lender in most states so if they did deposit the funds you owe them principal interest and fees.

You are in Maine and maine law states certain "supervised" lenders are legal. CashNets website shows a Maine license with a link to Maine licensing website. So yeah, they look like they are legal in your state and could sue you.

You need to cease and desist them IN WRITING. Verbal requests hold no legality.

Yeah you did....like most people you didnt read the fine print. Sounds like you do not monitor your bank account properly either . You need to start logging into your bank account every day and pay attention to what is going in and out.

Wow thank you very much but I most certainly did read every single word. I DO NOT ever sign anything without reading it. But I'm so pleased to see my only response so far blatantly calling me an idiot in nice terms.

Again, I did not ask for these loans, and I did not agree to them. And yes them calling me is harrassment and I have spoken to local law enforcement that happens to agree with me. I am in no way legally obligated to pay them back a single penny without having signed any sort of agreement or accepted any terms and conditions. To tell me otherwise is honestly pretty foolish.

And again, having people call me pretending to be lawyers and threatening me and calling me names? Not exactly something a real law office would do. Especially one that there is absolutely no info about online other than the FBI possibly investigating them.

And apparently you can't read either. They deposited the money on the exact same day that I got paid. Several days after I had inquired about info. The same day I got my bonus from work. (We got one every 3 months)

I wrote on here to find some sort of action to take against them. Not for someone to come on here and be a complete jerk to me and tell I'm completely in the wrong for signing a contract without reading it.

I read every single word. It was only to give my email address to lenders that would contact me and nothing more.

Also, after doing a fair amount of research I have found that ALL payday loan companies are illegal in the state of Maine.

CashNetUSA is a payday loan company are they not? They are not an exception. I believe the laws I have read on my state and government websites over their statements any day.

No, not all payday loans are illegal in Maine,

Maine Payday Loan Laws

State Legal Status
Lending of payday loans are prohibited in the State of Maine. But permission is granted for supervised lenders.

I am not saying you are an idiot...but why would you give them your bank account number for just an inquiry??? You put an app in with what sounds like a broker, like money mutual.

Also, CashNetUSA works as a CSO in many states. Your best bet is to go back through your bank statements and see if the money was deposited from both of these entities.

Ask the "collector" to send you something in writing. If they won't that's your first red flag they aren't legit.

If you do get anything in writing respond via mail requesting validation and demand to see a copy of the signed agreement. If they don't have one, you don't pay.

I explained to them that I never signed for any loan from them or accepted any and they bluntly called me a lying little prick.

I asked them their address and they refused to tell me. I asked them to mail me the information and they refused. I then had my phone company block their number and contacted the local police. I will be contacting the AG and FTC asap as well.

This isn't the first time they have done this to someone and I'm sure it won't be the last. But depositing money or withdrawing money to or from someones account without their permission is illegal in any state. I also asked for the date they deposited the money supposedly and they refused to give that to me as well. They then called me 27 times in the course of 3 minutes. Until I finally turned off my phone.
