if they put it in our account and we never applied for this loan why do we have to return it? wouldn't it be a gift? or can't we take them to court for illegally accessing our account?

Make sure you contact whoever the lender is and tell them you are not interested in their loan and are having your bank return the funds. Or else the lender may satrt automatically debiting your account!!
