HELP (Western Sky/Cash Call

Has anyone had any success in dealing with the Western Sky loans that were immediately transferred to Cash Call? I live in Texas and am current on the loan (since it is ACH'd out of my account). I have not been successful in getting any clear cut answers from Cash Call on being able to pay extra to be applied to principal to try to get this loan paid off early as I cannot keep on paying this outrageous interest with no relief on the principal. Because I haven't a clue and am fearful of what will happen if I default in an effort to force a settlement, I now find myself in a place to where I have paid over $3,600 on a loan for $2,525 with no end in sight. I feel like I was completely duped on the whole WS (but really CC) loan as I thought I was doing business with one company only to find out it was actually the other one the whole time. Also, I relied on the representative telling me I would NEVER owe more than I borrowed. That's BS - my payoff has consistently been over $300 more than my loan amount. Further, I was told I could pay the loan off early to avoid the high interest. On multiple ocassions I have tried to get information to forward money orders to be applied toward principal but am always given the run around and no assurances that any of the extra money I send would actually be applied to the principal.....basically unless it is posted on the 1st of the month (and I have no confidence that would happen no matter when I sent it in) that it would be applied to the interest and any left over would go to principal. So basically, unless I am sending in the full amount to pay off the loan I really can't get ahead. I have contacted the Texas AG who transferred me to the OCCC who really couldn't help me other than to reiterate to me that Western Sky is a tribal company and not registered in Texas but that they would review the docs and get back to me..... I have gone to my bank to talk to them and they are telling me that I cannot cancel an ACH on a PDL (which I am certain WS and CC sold the product as not being so they could skirt the Texas laws on that one since neither one of them are licensed as PDLs or CSOs) and that even if I closed the account and opened another one, the ACH would still be put through. Since I have my business and my son's account all at the same bank, switching banks isn't easy. When we lost the ability to control our own damn accounts is beyond me. I have put together a letter to WS/CC (using Ohiogal's example) to revoke ACH and request no contact other than through written means, but am scared to send it because I have read where they harass with phone calls even if you send a C&D. Since my job position is considered a consultant on a 1099 contract basis and not an actual employee, I don't want to risk losing my job that I have had for the past 8 years over harassing collection calls.

I should have known better than to get myself into this mess, but there was a death in the family that added two additional mouths for me to clothe and feed and sometimes in desperation we make poor decisions. I realize this will damage my credit but at this point I need relief so that I can quit losing sleep over this. I just want to know if anyone has successfully settled with these people.


There is nothing to be scared of. Go according to OhioGal's instructions and send the letter. And whatever your bank says about ACH, its just another pile of BS. You can revoke ACH, its guaranteed under federal law. Talk directly to the bank manager about this, not the teller or the customer service people.

And, you can inform your employer that you are being targeted by scammers and any calls he may receive of such nature should be promptly ignored.

Revoke ALL ach immediately. Register with the forum and I'll send you the phone number for CashCall's dispute resolution director. If your bank refuses then tell them you are going to file a complaint with the OCC and the fed because of the bank's ignoring of regulation E of the FDIC. CAll your bank's corporate office if you have to. Furthermore, I'd ask for the bank to give you a 100 dollar courtesy credit to your account for the bank manager blatantly lying to you.
