Today I received 7 letters from attorneys stating that Midland LLC had filed a civil lawsuit against my husband. What should I do? I have no money to pay this crditor, whoever it may be.

Hi

A letter is NOT the same as service of process, if the letter looks or is attempting to look like service of process you can, in some cases get the debt wiped out.

If you could post the letter or some of the phrases here it would help us to understand what is happening.

The worst thing you could do is ignore a summons/service. If they give you a phone number to call them .. i.e Joes Scary Lawfirm they are most likely NOT going to take you to court.

If you are given service of process it will tell you when to show up at court. Showing up and explaining your situation will not really help you.

If you are really and honestly stuck, you might want to consider bankruptcy.

Before you contact them you need to :

1) Understand what debt they are trying to collect on.
2) Know the statute of limitations on debt in your state
3) Understand that even if they get a $50,0000 gazillion dollar judgement, unless you committed fraud, (took a loan with the sole intention of going bankrupt etc.) if the VERY worse case you can file a BK ...AFTER they take you to court and get a nasty judgement.
4) They know this and if you can show them you know this as well you will be ok.
5) ANY INFO YOU GIVE .. will be used to start the clock ticking again be careful talking to them.

What state are you in ? It sounds like you are denying the debt. If this is the case send them a letter in the mail saying that you do not owe them anything.

There are many many similar postings to yours on the site.. and some fine help..

Best,
