Dear Debt Forum Experts:

HELP!

Being in a slightly-happy-delusional state, (from “legal” pharmaceutical enhancement) and the credit report guys commercial! I decided to check my check report! Not sure what I was thinking; but, here it is!

Credit Score: 598-not bad considering the train wreck my “credit report” actually looks-like!

Credit Report: (it’s bad)

I have a gadzillion charge-off’s!

I realize my credit is in the toilet! I have a few joint accounts- with I am behind on; but, slowly bringing current!

My Capital One car loan is current, (the car was originally re-poed in October 2011. I paid the ($900 bucks) and got it back, been current ever since then! (Have someone take your car once, and believe me every time ya hear a tow truck, paranoia actually kicks in…)

The statute of limitations in Pennsylvania is 4-years I believe for suing overa debt!

1- National Recovery Services (Dell)
The charged off amount was $2500, the original balance was much lower! I have already a king’s ransom, over the past two years). And I stopped paying in July. Dell still wanted to $700 dollars to settle the account, I said no! They can have another $300, and that’s it! Then I was told my account “would be transferred” from NRS’s office. Either Dell would drop the account, or send it to another collection agency.

2- Midland Credit (HSBC)
The charged off amount was $846, the original balance was: $628. Was charged in September 2009.

3- There are quite a few other charge offs from 2008 and earlier!

My question is: should I pay the past charge-offs? Or just let them hover and linger on my credit report? Or do a debt settlement via a reputable company?


Paying a charge off will do squat for your credit. A paid collection account does NOT raise your score If it is out of SOL, wait until it drops off.

For those accounts that have not reached the SOL, your choice is to try to settle them yourself or fly below the radar until the SOL runs out. Personally if they have been sold to a junk debt buyer, I would avoid paying anything.

The SoL clock starts ticking from the day of last account activity. Check for the accounts which are past the SoL of 4 years. The creditors and collectors can't sue you over them.

There is no real point in paying against charged-off accounts/accounts in collection as far as improving the state of your credit report is concerned. So if some account is past the SoL, do not bother about them. Instead, aim at settling those accounts which can still be legally collected on.

As for the derogatory items on your report, they will fall off your credit report in 7 years (like the 2008 accounts will disappear in 2015).

I think my biggest concern is my Dell account. I think it was charged-off in approximately 2008-ish!

I have been paying Financial Recovery Services, for the past two years, not NRS!

I don???t know if I should continue paying FRS, or just hope and pray that Dell is happy with the amount they received!

Not sure what to do with Dell? Any suggestions? Advice?

The account was charged off (October 2008) I called Dell Financial Services (they claim FRS owns the debt)! When I called FRS to clarify this they ???claim??? Dell owns the account.

The original amount charged off: $2600

Current balance: $1600

It was usually the ???song and dance??? what do I intend to do; regarding the account, yada-yada-yada....

Then I was told that Dell could pull the account at any time from their office! I am guessing this is another scare tactic!

The client can pull an account at any time for non collections,.,.so no it is not a scare tactic. They can then place it with another CA or even a law firm for collections.

???They lied???

I called Dell Financial Services, and spoke with a lovely woman named Jackie! She explained that once a Dell account is charged-off, the account is ???sold??????.
So Financial Recovery Services ???lied??? to me, isn???t that a shock!

For the past two years I have been making payments to Financial Recovery Services, the statute of limitations for this debt is October 2012!

My question is: Did I reset the statute of limitation since; I paid this debt directly to collection and not Dell.

The Dell account and Financial Recovery Services are not showing up on my credit!

Advice? Suggestions?

I have a bad feeling about this Barb.

Did you ever ask this CA to validate the debt or did you just start paying them.

In PA, the SOL is 4 years. If your account was written off in '08, it's likely it was at least 6 months past due at that point so the date of your last payment may have been in '07.

I have a feeling this account was past SOL when you started paying the CA. It looks like PA's laws, however, state "date of last activity." You may have started the SOL running again by making those payments.

The collection agency has the right to collect!

The statute of limitations does not apply, since you paid on this account!

So ha ha ha ha you need to pay!

And believe me, Dell and Financial Recovery Services will sue you in court! So get ready to go to court, if you don't pay!

Pay your bills, and this won't happen!

I have worked with Dell and FRS before when I had a charge off in 2011 - please let me know if you have done anything with this so I can help you with how to deal with them.

The Dell account was charged off in November 2008

The charge off amount was $2500.

I paid about $1100 via FRS (collection agency). About $1400 is fees!
I sent a letter FRS and offered to pay another $125. FRS returned the account to Dell's own private collection department.

Dell wants another $780 to settle the account.

The last payment was via FRS in August 2012.
