FBCS Call...please help?


I got a phone call from FBCS saying they are collecting on a debt from Asset Acceptance...they were very pushy and claimed to have sent me letters (I had never heard of them before, though I have heard of Asset and had dealt with them).

Does anyone know anything about these people? Are these one of the bad CA's? I'm worried based on the nature of the call.


never trust anybody,or anything connected with assett acceptance.they can claim anything they like.bottomline is you never received anything but calls so state you will not talk to them again until you receive a letter.then follow through and do not engage them further.to close any place connected to assett is not good,and should be treated as such.

I would inform them, if they call again, that you are awaiting receipt of their formal collection (dunning) notice, and will not discuss anything on the merits with them until such time as you have been formally advised of their collection activities.
Of course, they are going to argue that they have done that. I would simply tell them that you have received nothing, and are in the process of sending a formal complaint to the FTC for their violation of FDCPA 809(a). They can take up the matter of proof of dunning notice with the FTC.

I would additionally ask them, if you dont have it, for their mailing address so that you can send them a debt validation letter under FDCPA 809(b). If they refuse to do that, then you are really dealing with a debt collector trying to avoid their responsibilities under the FDCPA, and are denying you your rights to request debt validation.

As an aside, since Asset is also a debt collector, you are dealing with a debt collector collecting on behalf of another debt collector. It is getting down the food chain, which probably explains their agressiveness. They are desparate. Make them first comply with the statute, and I would guess you wont hear from them again.

I got another call from these people...this was after I got a litter with a settlement offer due 11/12. They continued to bully on the phone and after some back and forth I just hung up.

Basically, I just don't want to get sued...I'm afraid that they will pursue such action. I said I would respond to the letter and that I would validate the debt but they keep pushing. It's really frustrating and I'm somewhat worried.
