Discover/Financial Recovery Services DV?..
I rec'd a letter from Financial Recovery Services stating they are trying to collect a debt for Discover Card..I immediately sent a Debt Validation request Cert' Mail/Return Receipt Requested...They did receive my DV...
NOW, I just rec'd a letter from Discover stating,
"They have been made aware of my dispute...In order to assist us with our invetigation, we are requesting the following information:
1) Copy of my Driver's license or any official document containing my signature
2) A detailed letter including any documnentation to substantiate my dispute"
That's It!!..They supplied none of the documnets I requested in my DV letter...Wouldn't they have a copy of my signature from the original account opening docs?..It sounds like they don't have any of that anymore..(I opened this account a LONG time ago..) How should I proceed?...Any help would be great!..Thanks Everybody!...

Since the CA has not sent satisfactory proof to validate your debt, now you should send them the following documents:
- A copy of your debt validation letter.
- A copy of the return receipt of your letter.
- A letter stating that they have violated the FDCPA
As per the FDCPA, the CA which can't or doesn't validate your debts properly can no longer continue collection processes.

They have not violated the FDCPA yet. All they did was ask for more information. That is not collection activity. However, it does set the stage for possible violations. I would send them nothing that they asked for. Instead, I would send them a certified letter that reads something like this:

To Whom it May Concern:
I am in receipt of your letter, dated (date), in which you asked me to provide you with additional information regarding my dispute.
As I am sure you are aware, the Fair Debt Collection Practices Act requires that once I provide you with a timely written notice of dispute, it is then your responsibility to provide me with proof of your claims. It is not my responsibility to provide you with anything other than the notice of dispute. I provided this notice and I did so within 30 days of initial contact, precisely as the law requires. I have included with this letter a copy of that dispute notification as well as a copy of the USPS receipt card that shows that you received it.
You have made claims against me, which by law you are now required to prove. I will not be providing you with any additional personal information; not only does the law not require me to, but if your claims of indebtedness were correct, you would already have this information in your possession anyways. I will also not be providing you with any personal documents such as a copy of my driver's license. As a debt collector, I have no doubt that you are aware of the negative reputation your industry has earned. It is historical fact that many debt collectors have obtained signatures from consumers for the purpose of forging documents. Again, if your claims were correct, you would have such documentation already in your possession. FDCPA states that you are to provide me with proper legal validation of this debt. The FDCPA also states that you are to cease all collection effort until such time as you do provide that validation to me in writing.
I must inform and warn you that should you continue collection efforts without providing validation first, I will have no choice but to take further action, including possibly legal action, against you as provided by law in order to protect my rights.

the letter came from discover really?i would call discover about this.was the letter on discover stationary with their letterhead?if not they the CA sent you the letter and tried to make it look like it came from discover.my dad had them,and they are very thorough with their records.this does not sound like discover at all.send the letter to the CA first.this sounds like JDB bottomfeeder all over it.

If it is really from Discover, wouldn't they already have my signature from the account opening documents?...I opened the account 23 years ago...Maybe they got rid of all the original paperwork?...Thanks!..
