Loan Point USA

I live in NY and hav a loan with loanpoint usa - I have paid them 640 of the 700 I owed then realized they were illegal and closed my bank account etc. well the calls have started and I guess how do I make them stop? I sent the c&D letter, I spoke with the people yesterday, who I might add couldn't speak english. I asked for a validation letter, etc etc. and the only thing they would say is I'm being charged with three felony counts of fraud. They left several messages at my work and on my cell and each time I asked them a question all they would say is see you in court, have your lawyer call me and then one just hung up on me. What do I do next?

Yes I do know they can't sue me but what do I do? They won't answer a question, give me a name, address, anything - they just keep calling my work and my cell - how do I make it stop or pay the stupid 60.00 left on the principal if I can't get them to answer a question? I filed with the FTC but all I has was the stupid # they called from. I was actually laughing on the phone because I asked for someone who spke english and got a guy who spoke worse than the first and I could hear them in the backround all reading their script of getting sued and 3 counts of fraud blah blah blah

There isn't much you can do, it isn't up to you to hunt them down so you can pay off your loan, it's up to them to provide an address, if they won't, then it's their loss.

I have just recently lost my job and I got a loan with them for 600 dollars, they are threatning me and saying I will go to jail for fraud, I live in Florida, is this possible or is this a scare tactic, should I be worried, I offered to pay little by little as I lost my job and am on unemployment but get no answer or success...what should I do.

They aren't even licensed in FL! CLICK HERE to find out how to deal with illegal lenders.

also I read in FL the maximum loan amount you can get is 500.00 they gave me 600.00 this is what it says....

Legal Status: Legal

Fl. Stat. Ann. 560.401 et seq.; Rule 69V-560.901-912
Loan Terms:
Maximum Loan Amount: $500
Loan Term: 7-31 days
Maximum Finance Rate and Fees: 10% + verification fee
Finance Charge for 14-day $100 loan: $15
APR for 14-day $100 loan: 390%
Debt Limits:

Rollovers Permitted: None (cannot rollover)
Cooling-off Period: 24 hours
Repayment Plan: Yes
Collection Limits:
Collection Fees: All charges imposed on the lender by any financial institution; lender not entitled to treble damages

they are threatning to put me in jail for fraud because I have not paid them I see under criminal action it says Prohibited...so does this mean by the state of FL they cannot put me in jail for this loan also the max for FL is 500 they gave me 600..any help would be highly appreciated.

I had a similar situation. I paid $720 towards a $600 loan and had to close my account. I opened a new account and within days of opening the new account, they deducted $400. My bank has reversed it, but i am concerned that they will try again. They claim the contract states that they can make any amount of withdrawal at any time. I requested that they cease the ACH but said they would continue to do so. I asked for an address and they gave me: 1338 South Foothill Dr, Suite 325, Salt Lake City, UT 84108- not sure if it's legit. I too am pursuing legal action. I live in Massachusetts and have a contact at the attorney general's office and will see what my options are.

I have dealt with them before I had found this forum or I might not have sttled with them. I had a signed agreement including a PIF statement for $240. I had closed my account but they had been able to find my new account information almost a year after I had opened it. Using that section that states they may withdraw from any account you may have they took out $400. The service rep on the line said that since I had paid only $240 of the $300 it negated the offer of $300. All because some rep did not update the notes (UHHUH). I faxed the signed agreement to them and suddenly no one would talk to me. The bank restored the funds and continued a fraud investigation. Be careful with these guys and document like crazy.
