Pressler & Pressler... I need to prepare
I live in Southern NJ. Just one month ago, my discover card charged off at 180 days delinquency. I was laid off early in 2009 and had been unemployed for 7 months. I was not able to pay my monthly payments after a little while without a job. I even tried a hardship program but couldn't afford that either. Right before the end of last month (the end of May) I received an ATTORNEY PLACEMENT PENDING letter sent Priority Mail from Discover stating that if I did not pay the balance of $11,988 or call to make arrangements with them by May 31st, 2010, my account would be forwarded to an attorney who could file for a judgement against me. After much research on the web, I disregarded the letter in order to make settlement with a collection agency once the account was charged-off.
I moved in with family within the last 2 weeks because I couldn't afford to pay rent at my old address anymore. I have a job now, but it's commission based so I never know what I will be bringing home, and hourly it's minimum wage.
I have forwarded all US mail to my new address, and just today received a letter from the notorious Pressler and Pressler. The letter was postmarked 6/7/10 which is exactly a week ago and it was sent to my previous address. The letter states as follows:

I have read so many horror stories on P&P. I do not want this to escalate to court or judgement. I have been pulling all funds from my bank account in fear that they will levy it or freeze it without notifying me. I'm also afraid that if I do not take some action, P&P will knowingly send a summons to my old address in order to default judgement. I'm afraid to even call the office of P&P because I know that they will hold everything I say against me, and they are known for making empty promises. I have about $3,500 right now for settlement. Is this still in Discover's hands? How do I go about settlement? Is P&P even a law firm or are they simply debt collectors? I just want some steps in the right direction because I have no clue where to start. And I really want to avoid this getting ugly. Please help.

Nope, the account has been charged off and sent to Pressler & Pressler. IMO you must call them up and make your offer. It would allow you to buy time and stop them from filing lawsuit immediately.
If the collector has to sue you, it has to do it at your present county. Otherwise a default judgement can get vacated on the ground of improper delivery of summons. But to avoid it negotiating with them is your option.
Don't be scared. Even a law firm is bound by the laws when acting as a third party debt collector.
