They referenced an HFC account in which we have fallen behind with. They claimed to have sent info to me in the mail in December 09, but they had an old address and I did not receive it. This is a red flag since I received mail at my new address from HFC from 12/08 -present. The rep at Rolfe and Lobello was unsure why they did not have my new address. I gave them the new address and they are to send me the info. The person I was speaking with claimed they were ready to go forward legally and try to get a judgement. But that they wanted to try to contact me first. They tried my phone since I didnt answer the mailing.
So this is my game plan:
Wait for the new mailing to my address.
Send a DV letter to them.
Once I receive a response to my DV (if I do) proceed from there.
Because they are speaking about legal action, I did check with my circuit court online just now, but did not see anything. They did not say they had filed but were ready to.
But let me verify my understanding of the legal process if that occurs:
They file in my county.
I receive info from the court and have 30 days to respond.
Go to court and explain my situation and see what happens.
I have two other questions: 1. during the thirty days I would still have time settle with them or file bankruptcy if I had to right? 2. Do lawyers have to follow the same rules about not calling me if I request it?
I was surprised that there were not any post about them here. I will say the rep was not high pressure and seemed accomadating. But not having my current address makes me wonder.

well if suit wasn't filed then i would get a DV letter out.yes while they can sue they are subject to the FDCPA since they are attempting to collect a debt.so get the letter out,and proceed from there.send it certified mail return receipt.

first you need to verify the summons is real.check with your court clerk's website for this.if it is legit you need to respond asap.motion to request validation during discovery.if they haven't filed suite,then get out a DV letter asap.check with your court clerk as they must sue in your county,village,or bourough.verify by the docket number that they have filed suite.then we'll proceed from there.

I am beginning to wonder if Rolf and Lobello are legit. I sent them a cretified DV letter this past Tuesday. Today I got a call from them and it was not the person I had been working with. When I explained that I had been working with someone else, I was transfered to the correct person. The correct person said they were getting ready to seek judgement and I needed to act. I told her twice that I sent a certified DV letter, that I was concerned she did not have my correct address. I gave her the parcel number and expained that all collection activities must stop until they validate. I had to say it to her again as she started wanting me to do something. They appear legit, but they certainly act like a CA, not a law office.
Any advice ?

wait until they sign for the DV letter.you can even check with the P.O and get a status on whether they received it or not.i agree,the person is a lying putz.they have to file suit to get a judgement.they can't just seek one.typical bottomfeeder.i'm not really suprised.
