Thanks! I am willing to share any information that we have learned in our process. We had kept a couple of gas cards that we had continued to make timely payments on and we have just paid them ALL off. We are starting 2011 with NO credit card debt. I asked my husband how long it had been since he could say that and it's been years. I got my first card right out of high school and have owed since. More than 25 years! No more and we will never use credit cards again. So relieved it is behind us!

I sent this note to Jason expressing my appreciation and I'd like to re-post it here:

It is I who should thank you and the people who make web sites such as this one available so that we can learn to defend ourselves against what is in many cases a stacked deck. I have learned that sad fact all too well, that it is not a level playing field we face.

Maybe you would like to read some quotes presented by Midland Funding and Encore to the FTC round table discussion about the current state of collection efforts in the courts and the self-serving statements they make. It's hard for me to read them with a straight face, especially in light of the fact that junk debt buyers DEPEND on default judgments to be profitable. It has been established by studies in both New York and Ohio that when these 3rd party debt buyer are met in court with defendants who have obtained legal counsel in almost all instances the cases are withdrawn. Which shows that they aren't there to "play fair" or present a valid claim, they are there to take advantage of people ill-equipped to defend themselves in a courtroom where they have precious little experience or knowledge as compared to attorneys in the junk debt business who are well-trained how to succeed, i.e. "trick" the court and the debtor.

Our enforcement of a valid contract through the legal process is an expensive but necessary component of collections, and it is our hope that the roundtable discussions will provide the information needed to preserve the litigation process and protect both consumers and collection agencies against regulations that keep the flexibility and predictability that allow us to best work with our customers to find mutually-beneficial solutions.

In our view, the rate of default judgments does not depend on the type of action but rather on the processes in place for a particular court or judge to make a decision in a case where the defendant has failed to file an appearance or responsive pleading, and has similarly failed to physically appear before the court. We would prefer that consumers appear so that we may discuss the account, their financial situation, and payment options, but they do not go to court, and that is the reason for the large numbers of default judgments.

So, let me THANK YOU for the opportunity to gain enough knowledge through what we share here so that we can have a decent chance of defending ourselves.
