My friend's BK7

A friend of over 10 years is in BK7. I have helped him (not to be show-off or anything) very much and even paid is debts over $20K. Three years ago he sold his place and paid me back. And $17K he decided to split it with me, (and we spent it together)to let me know his appreciation. Two years after that, (he is very private person) I found out that he was in economical trouble again... to make long story short, I called all his CC and canceled them all, again... and very desperately he had no other choice but going for BK7.
Now, his BK trustee is coming after me and wants back $17K that half if it was given to me as a gift.
I feel threatened, humiliated, and have no idea what to do.


As I said above it was three years ago, or something like that, and he made sure and promised to himself that there won't be anymore. He said if I don't have any money on me, I won't spend any, but the reality proved other way. He is diagnosed for so many year with OCD. (I didn't know that) As we see he is trying to fight his illness. I feel bad now. If I have the money, I was going to give it back to him, but momentarily I am not working.
My question: why BK trustee is after me?

because your friend informed the trustee of this gift.if you have to go to naca.net and ask a consumer attorney about this.i would think that after all you've done for him he thanks you in this way.i for one wouldn't feel the need to pay it back now.

Thank you guys. You made me feel a bit better. It hurts to see you friend suffering and yet, somehow it's my fault ( at least in a trustee's eyes)

Sorry, but I am not getting you SOAPLADY: I explained very well how and when happen. I believe no one wants to go through HELL with the BK and all... but uncontrolled circumstances, sometimes, take the best out of us. (in this case it was his illness, which no one seems to care) I hope you donate a little bit of your time to different charities, as I do, trying to understand the majority of the population.

NO ONE WANT TO BE IN DEBT! And we all know that. My friend, never had BK before, he tried to pay his debt on time, but as CCs love to, he made minimum payments, so, his credit score could be higher. And I told him so many times: Don't listen to CC companies who are happier with minimum payments. Anyway... all of the sudden, the minimum payments doubled in the beginning of 2008 year, and here he is know. For 30+ years he paid minimum, and made the CC companies happier... but now... no one cares. He is filled with "shame" and somehow he said, it is his fault, because certain interests want him to feel that way and they are doing pretty good job, as you see.

Agreed. That's sounds wrong that they over going after you from something that was given to you 2-3 years ago. Get a lawyer. I think the law's on your side in this case.

Now if he gave you that money with the last 3-6 months (of his filing for BK), that would be different.

As you all are suggesting, I will take this situation to next level and will let you know the outcome.
