Getting ready to file Chap 7 in CA and have a few questions

I'm getting ready to help a family member with their BK

Our questions:

So far the 2 attorney's we met with are within a few hundred dollars in price...Both are around $2000 to $2300 which includes my $50 for the cert and the filing fees.
One attorney said they can pay a $1000 fee up front along with the $50 fee and filing fees with it.
The second attorney said they need to pay everything up front. When she asked him he said as the attorney needs to be paid off so he's not considered a creditor. Does that sound right?

Both attorneys say I will not be paying any extra money to a trustee, but I keep seeing posts here with people mentioning they are paying and are in Chapt 7. What's the correct answer?


When they go to bankruptcy court is it normal that some companies will try and dispute me going chapter 7?

As per the recent bankruptcy law, before you file bankruptcy, you need to undergo a 180 days credit counseling program which will decide whether you will qualify for Chapter 7 or Chapter 13. If you have sufficient income to pay off the debt within a 3 to 4 year period, then you need to file bankruptcy under Chapter 13. However, if you qualify for Chapter 7 and have certain non-exempt assets, the court may sell it to repay at least a portion of the debt.
