Fax Numbers for a Few Credit card companies..


I have Faxed Cease and Desist Letters to the following and they all have accepted the faxes in Lieu of mailing them(so far). I suggest you print out a transmission report after the fax goes through. I have not been contacted by any on the firms listed after I sent the "cease and desist" letter.

Naturally, Certified mail is probably better, but fax has worked so far.

All of these are good numbers as of today's date: 3/16/09

All Require you mailing address and Account Number on the "cease and desist letter"

Faxes:
Chase 888-643-9628

Citi (Rooms to Go) 866-240-6840

Capatial One 888-259-3021 (note, requires you SS# and DOB on the letter)

Encore Receivable Managment (handles Dell) 913-393-5726

URS (United Recovery Systems) handles HSBC 713-977-0119

According to the FDCPA, the Cease & Desist letter must be in writing for the creditor to be forced to honor it. While faxing is a form of writing, it is never good to fax it. Just because you have proof that it was received does not mean it actually was. Faxes jam, run out of toner, get piled up somewhere in a file, etc., etc. ALWAYS send Cease & Desist letters by Certified Mail Return Receipt Requested. If it went to court, the company may easily wiggle away from a faxed notice but a hand written signature on the USPS green card is absolutely ironclad proof in a court of law. I would treat the fax like the phone, expect a break for a week or two, but send out those letters in hard copy by mail.

Plus, you really can't PROVE that the fax receipt is real. One can easily draw one up on a computer.

Oh, and those Cease and Desist letters don't work for the original creditor.

Although I agree with you that certified mail is better, my thoughts are if the Fax letter works and they don't call after you fax them, great, you just saved a little money. If the calls continue, then send them the certified mail.

In regard to the original creditor...the Cease and Desist letters do work....at least with my Creditors..ie Citi/Chase/Capital one.
