Wage garnishment and Tax refund offest
My Student Loans are in default and the garnishment process has been underway for about 3 months now. I would like to know is it legal for the garnishment agency to also offset my IRS tax refund if I'm making ontime payments on a bi-weekly basis totaling for more then $1000/month? Also, do they typically go after the State refund too?

Yes. You are in default and they do have that right especially
Yes. You are in default and they do have that right especially since you are being garnished...your payments on not deemed "on time" since they are being taken involuntarily. And yes they can take the state taxes too.
