I took our student loans to attend a college in one state...now I live in another state and don't work so I file married filing jointly on my income taxes under my husband's income...can they take my state taxes under these circumstances, as well as my federal?

Oh yeah. If these are federal loans, they can seize any federal repayment due to you.....it doesnt matter what state you live in.

Your husband may qualify for Injured Spouse Relief http://www.irs.gov/pub/irs-pdf/f8379.pdf to get all or a portion of the offset back. If all of the income is his, and it can be proven.
If you live in a community property state, you might not be granted any relief!
