My brother ex wife and his daughter applied for a U.S. Depart. of education loan for daughter to attend college. I do not have all the details the the main detail is during the time they applied my brother was living in my house as they were separated at the time.
2 Yrs. ago Depart of Education sent bills to him so I wrote them back informing them that he was living with my husband and i due to their separation. My brother also wrote to them to let them know that he had no knowledge of the loan and that they apparently forge his signature on the loan applicatons and papers. Now allied interstate is trying to collect this money. I was wondering if its true that they can Administrative Wage Garnishment on his pay check. And, also in my experience, which isnt much but a isnt a federal student loan the responsiblity of the student. I know my son was paying forever for trying not to repay his student loan and even though so of my information was given to them it never affected my credit and they never tried to collect from me. Does anyone know the law for a collect agency in regards to garnishments?


Sounds like this could be a Parent Plus Loan where the parent takes on full responsiblity.

Your brother will have contact Allied and get copies of the prom note. Then he will have to file a police report for fraud....forgery is a federal offense so his wife and the daughter may be charged. If he doesnt follow thru with these steps, he will be garnished and his tax returns offset if he is not volunarily paying on the account.
