I have a defaulted student loan. I have tried over the years to correct this but Sallie mae always wanted way more than I could afford each month. The only thing I could do was forbearances and income sensitive, which was still too much to keep up with, and the interest, of course, never stops.
I tried rehabilitation but the amount they wanted was again beyond my ability to pay.
I am on disability and I only work part time (about 20 Hours a week) I am not 100% totally disabled and I can still walk so I can't have them discharged that way.
I found information about "Reasonable and Affordable" Payments and I printed out the form and the chart that goes with it. According to the chart I could pay $25.00 per month and stay out of default.
I sent it all in and I was denied. They said they would only accept $100 per month. I can't afford that much and that isn't what the chart said so I resubmitted everything.
They turned me down again and said I had to be on some kind of social services to be eligible. I re-submitted again and sent a copy of my Medicaid certification.
Again I was denied and sent to collections. I got a letter from GRS collection agency and wrote to them that I was disputing the charges.
I don't think it should have been sent to collections.
I am now getting calls from ECMC and I refuse to answer them. They have never sent me anything by mail.
Isnt there anyhting I can do? I never tried to run a way from this but I have never been able to give them what they want and the "affordable" amounts are not affordable at all.
I see no way out of this. Any advice?

The definition is "reasonable and affordable". It has to be affordable to you, and reasaonable to your guarantor. $25 is below the minimum payment for any loan. With a payment that low, they would be setting you up to redefault againn because you would not be able to make the required payments after rehab.
You are in default...medical certifications dont mean anything and the guarantor can send you to collections at anytime....it is there decision.
What was the point in disputing the charges??? Obviously you know you owe it and the CA can get the prom note in a snap. Kind of a waste of a stamp.
Best option for you would be to consolidate with the Direct Loan Consolidation Loan program. You will automatically be assigned to the Income Contingent Repayment Plan. Link are in the sticky section at the top of this forum.

I disputed the charges because financially I qualified for the Reasonable and Affordable payment plan under the rules of NYSHESC. It was THROUGH their website that I found the information, the payment chart and the application. They would not accept me even though I qualified under their guidelines.
If CA can get that Prom in a snap then why haven't they? Why send me crappy copies of lists of numbers with no other info? I don't care if they can get the note. I want to see it so I can make sure I'm going to be sued for the right amount!

I am extremely worried that my tax refund will get seized & I will try to talk to the loan company to see if I can consolidate, as my loan is in default, but it's very stressing and depressing.
I only eat one meal a day because I have no food. My parents won't help me out & my boyfriend gets me food when we hang out (a box of pasta for example), but I'm still starving =3

I believe the site was put together by a well respected consumer advocate staff attorney at NCLC.
She also spoke about a new federal program that has passed recently that will allow for a repayment structure based on income. If memory serves, even if it is $25.00 a month. It does not go into effect until June 09 though (also by memory so please forgive if incorrect).
