student loan wage garnishment


hi, I received notice of admin wage garnishment postmarked nov. 28th. I contacted the CA handling my loan and was advised consolidation would pull it out of default. I filed all consolidation forms online dec 23rd, contacted DOE and was advised everything was fine and would receive consolidation payment info in approx. 30 days. the woman from DOE advised me no need to contact the CA... then I received mail from DOE stating my consolidation app was cancelled because the CA filed for wage garnishment jan 2nd and sent paperwork to my payroll office. today I mailed all necessary paperworl for a request for hearing. what should I expect? I feel like a fool for believing that woman from DOE. do I have ANY options to stop this action? thank you for your time.


awg paperwork was mailed today. when apeaking with the CA I was advised to contact DOE by brad at collecto inc. he told me to apply for consolidation, no payment necessary at that time, dec 23rd. I confirmed with DOE rep Nessa dec 26th that consolidation was certifying, no garnishment paperwork would be sent to my ppayroll, etc. she is the one who advised 30 days for the consildation paperwork to be mailed and not to contact CA as DOE would send them notice of consolidation. then on jan 2nd, a week later, the CA advised me of garnishment being sent to my payroll office. the CA also advised me of the request for hearing.

Unfortunately you had to repspond to the AWG notice within 30 days of the date of the letter. Once that letter is issued, you should not have listened to what anyone else said. DOE reps should not have been communicating with you since you were assigned to a CA.

You will get a hearing but since you did not submit the hearing request timely, you are basically inline behind all the others who did submit on time. It will take time and the garnishment will not be withdrawn until such time.

I live in calif and just received wage assignment from collection agency for a defaulted student loan. Is there anything that I can do to stop this process. I have left 2 phone messages for the person handling the wage assignment at the collection agency but have not yet received a call back

I have a wage assignment from my current employer for my student loans. I want to purchase a home next year, but am afraid I won't be able to b/c of this. Is there any way that I can change this to make sure they still get their money, but it doesn't prevent me from purchasing a home. My stundent loans are pretty heavy so I know I can't pay them off by next year. Thank you!

You have a wage garnishment from for a federal debt. It is not likely that you will be able to qualify for a mortgage until this is resolved. Once you default, you become ineligible for FHA/VA mortgages and with the way the economy is right now, no one else is likely to touch you either.

I was informed on Monday by a collection agency that there was a 'wage garnishment' that is going to be 'auto submitted' on April 24th and that if I send them money now, they can stop the said auto submit and i can enroll in their program for an amount that is way more than i can afford i would give me a severe hardship. I asked the CA to please send me information on this garnishment and what their 'program' of 6-9 months is that they want me to sign up for and they said that they would send me this info AFTER i pay them 400 bucks. They were pressuring me to give them my checking account information or a credit card number that they can use to deduct what they feel is the what i should pay each month. SERIOUSLY!! So i asked them again if they could email me the information so that i can review what they saying. I know i have defaulted on my student loans and want to get this matter cleared up, but if this CA is not willing to give me all the information up front so that i know i am not getting ripped off, then where do i go for help?? The CAs passed my call around to other ppl within their company, because i kept asking questions and not everyone had the answers i needed. All I want is to keep this from becoming a wage garnishment, and pay an amount that I can afford and still pay my other bills and how about eat every month. Confused, frustrated and scared. Please help me.
