chapter 7 dismissed

I received a letter yesterday saying that my chapter seven bankruptcy was dismissed because they did not get proof of income. Everything else was filed correctly and we already had a meating with the creditors. Is there anything I can do to rectify this or can I refile?


Were you using an attorney, or did you do this pro se? If you had an attorney, then get him on the horn and make him fix it.

If you did it pro se, you can file a motion to vacate the dismissal. But that's easier said than done, because it is very technical and you basically have to write like an attorney.

Calling the court isn't going to do much, because they don't provide legal advice. The trustee won't do much for you either, because he is the one that motioned for the dismissal in the first place. As a last resort, you can always file a new case (but in the case of repeat-filing, you might only get a 30-day stay of collection until the case is actually discharged).
