SLM Student Loan CoSigner Release


Here is a long question. Maybe the SoapLady can help or anyone else. My girlfriend (gf) is a cosigner on her daughters Sallie Mae Student Loan. My gf's ExHusband is the PRIMARY CoSigner on the loan which was obtained in 2003. When she got divorced in 2005, the decree says that my gf will be responsible for the loan and that the ex was "absolved" of it. The daugther has defaulted on the loan and my girlfriend can not make payments and the exhusband is demanding she get him released from loan. No banks will refiance the loan and Sallie Mae will not take his name off the loan. My girlfriends credit is so bad now that banks wont even consider assistance. She had a 800+ score before the default. We live in New Jersey.

QUESTIONS:

Can a divorce court judge force Sallie Mae to release the exhusband?

Can the exhusband take my girlfriend back into court to compel payments she already can not make?

What options are available to get the exhusand off the loan?

Why is Sallie Mae taking so long to start garnishment of his wages? He makes over $100K yearly.

My girlfriend is content in just letting the loan go unpaid forever. I have provided a home and all other needs for her. Her ex is trying to buy rental properties and other items and is experiencing problems. I guess he has the most to lose and he is VERY upset about it. But even if my gf wanted to, it does not seem as if Sallie Mae will take his name off the loan.

Any suggestions or answers will be VERY WELCOME!!!!


Sallie Mae is under no obligation to release the ex husband. Basically SM is not party to the divorce....and if if the courts demands someone pays, that will not change what is going on with SM.
I am assuming this is a private loan....SM will end up s uing all parties for judgement which takes time. Meanwhile interest is accruing and capitalizing.

years ago ,I have cosigning a student loan for a nephew.The loan went into default; meanwhile my nephew is working earning make more money than I do. Why can Sml retrieve his
ss# and makes him pay or ganish his check instead of going after the cosigner?

my mother signed for one of her grandson's (my nephew)student loans. she now needs to go into assisted living and her income is going to be taken over my the facility. what happens if the grandson doesn't pay and her wages go straight to the facility?

My husbands signed as a cosigner for a cousin of his for $ 30.000 years ago. But recently we found out she forged his signature in 5 more loans for $ 70.000. Can my husband be realead of the ones he did sign? If we go to the police and report her, Sallie M must removed him from the loans of we have to suit his cousin ?

No, he will not be released from the one he did sign....that is a legitimate loan and he will be held responsible for that one.

You will need to get copies of all the prom notes before you file a police report. You will then need to send the police report and statements to sallie mae. Is the cousin aware she could be looking at jail time and criminal prosecution? Sallie Mae will prosecute to the fullest extent of the law.

I asked my father to co-sign a loan with Sallie Mae for my daughter's education. I have been making the payments on the loan. My daughter is unemployed. My Mother is terminally ill and due to Sallie Mae his credit rating has been severely limited.My father now can not borrow any money to pay for funeral expenses. HOw can I get Sallie MAe to release my Dad as a co-signer. What percentage of the present loan total will they charge to release the co-signer?
