Student Loan Garnishment
:?: Apologies before I begin because this may get wordy. OK, I attended online classes about 5 years ago where I obtained a student loan. I had to drop out because I was incarcerated for 18 months in 2006. Came home, started working again and then received something in the mail from ECMC stating they were going to garnish my wages and take any tax refunds coming to me. I immediately called them and made them aware of my situaton and I was told once I made 9 consectutive voluntary payments (which I worked out to $50 a month for an approx. $4500 loan) they would remove the default and I could make regular monthly payments. Well along came some hardship and I took out some payday loans. Long story short, 9th payment rolls around and I had to close my bank account because of the ridiculous fees for the payday loans. I tried working with them to have money sent but they needed updated checking account information that I did not have. Now my wages are being garnished for $180 every 2 weeks. I was on my last payment of $50 and now this. Is there anything I can do to have the garnishment removed or at least reduced.

Was there a court case filed? if not then the only way they can be garnishing your wages is through a voluntary wage assignment - which you can revoke. If there was a court order then the employer has the right to withhold.
They do not need a judgement for federally backed student loans.

You would have been sent a 30 day notice of garnishment...did you not respond to it? How many payments were missed before they started garnishing you??
