disabled and need help - declare chapter 7

I have finally decided to declare chapter 7. Instead of
spending time trying to fight and DV debt collectors.
I have almost no income, only $300 a month from disability, no assets and about 10 unsecured debts,
including a judgment. I had 15 others but they are payed
off, closed and in good standing.

My total debts are about $10,000

My question is, am I able to get free help with this?
I can't afford an attorney obviously and I can't pay the
3 credit cards I have now, all under $400. The rest are charge offs.

I was told that because I am income exempt, I don't have to pay to file and everything would be provided for me. I plan on going back to work in a few years but I want a fresh start and stop the madness.

Any help would be appreciated.


Check with your local legal aid society that way you know exactly what you need to do. I believe there is a form that you have to fill out to get your bankruptcy filed without having to pay anything but I am not sure. Even though you are on disability and your disability wages cannot be garnished, when and if you do get to go back to work your creditors will more than likely come after you.

Yes, if you make under a certain level, you can apply to be expempt from paying the filing fees.

But that doesn't help with the paperwork. You would still have to either pay for a lawyer, pay a paralegal, pay a internet bk preparer, or do it yourself.

IF - all your debts are unsecured and you have no real assets worth very much, the paperwork to file for Chapter 7 is not very difficult. You can find all the forms on the Federal BK Court website, and your local BK Court website. Your local site should also have a list of the forms you would need to file. If you can follow directions carefully, you can do the forms yourself. But I would not recommend it if you have a house you are trying to keep or other large assets.

Thanks, yeah I own nothing big, just a $80 TV, a p0ker chip set, and a small p0ker table.

I am on the phone right now with a legal advocacy group and they offer pro bono service for people in my situation. I have been on hold for half an hour so I will update when I know something.

I never heard back yet, still waiting.

Also my friend told me I shouldn't file chapter 7 for $10,000 of debt. He said it's going to ruin my name. I told him it's already ruined and that letting interest build up for the next 2 years will kill me if I do go back to work.

He said noone should file unless they have $70,000 in debt. Am I wrong for wanting a fresh start?

Thanks, I read one lawyers site in my state and he said your credit is already bad, clearing it up with chapter 7 will help because you won't have the bad debt anymore only the bankruptcy. It will take a few years to clear up and some people are ably to get low limit credit cars in less than a year to help rebuild. I don't plan on cards any time soon, if at all.

Would they give me any problems with old charge offs from say 4 years ago? I am just wondering if the courts are biased when it comes to that. I had problems in the past and could never catch up, and was near death back then so I didn't care.
