Being an account with the original creditor it looks like it is just over 150 days past due. Most creditors don't charge off until after 180 days.

It's been over 2 years since I made a payment. I used to have the account with Filene's but when they shut down it went to Macy's and I never got anything on it, I only recently got letters from a debt collector on it.

I am wondering if the debt collector who has it is reporting under the OC name. It says closed but still shows a balance. In my state, a collection agency cannot put an entry on a credit report in their name, only in the OC with written permission. I guess I will have to wait and see if I get anything in the mail, it has been almost a year since I seen anything.

Don't wait and see get proactive and investigate this yourself. Contact Macys via mail, see if they still hold the account. If they don't they will tell you who does.

Good idea. Also be advised that no collection agency under ANY circumstance can report as the original creditor. They must report it as a collection account under their name, this is part of supplying accurate information per the Fair Credit Reporting Act.

That brings up a question that I have. I've recently gotten letters/calls, from CA about a debt that is, AT LEAST 10 years old. It's not even on my CR anymore. If a debt is THAT old, can a CA call NOW and collect the debt? I'm not saying i don't owe the debt, I'm just wondering if a CA actually had a 'limit of time that they have to call/stop calling about a debt.

No they can still call because technically you still owe the debt. The only thing that saves you is if the SOL has expired. If it has, they cannot sue you. They are hoping that you don't know this and will attempt to collect. All you have to do is send a full C & D and tell them the SOL has expired. Don't tell them the debt is yours.

Yes making payments or telling them, usually in writing, the debt is yours will restart the SOL and they can sue after that.
