Student loan collection agencies


Well a CA tracked me down for the defaulted student loan..wow what a rude person! I called the student loan place but they said I have to deal with who holds the loan. My question is do student loan CA's have to abide by the laws on debt collecting both federal and state? If I hadn't of just seen these things on my credit report he would have taken me by total surprise....barely identified himself and said, "You have defaulted on these loans. You owe $3000+, are you going to pay or are you refusing to pay the federal government. Wow...I was totally intimidated, which I am sure was what he was going for!

Any other CA and I wouldn't hesitate to slap them with a DV...but I am not sure I should rock the boat...I know I owe the loan (though I am still sure it was discharged..but oh well...guess it wasn't.) I'm just worried they won't let me make payments or anything.

The company is Default Resolution Group oh BTW, the state of Texas requires CA's to have a surety bond...I checked and this place does not appear to have one..does that help me any?


update: the company is west asset management..they totally misrepresented themselves and told me they were the holder but they are just the CA.

I found what form I filled out to get the loan discharged, it was: Loan Discharge Application: False Ceritification Ability to benifit. Took me a while of going through the forms to find the one that I had filled out. Basically when I went to school I was not a high school graduate or holder of a GED, they told me because of that I could get the loan discharged, so I filled it out and never heard from them again until I find out it is in default.

The CA is saying there is no form on file and now I have to pay, I can't even refile that form! That is totally bogus. :(

Yet another update:

I got upset with the CA because they told me 'too bad, pay up now or else.' So...I called the actual holder of the loans and while no form actually got filed (must have gotten lost in the mail) they have placed a hold on the account and are mailing me the discharge form to re-fill out.

I called back the CA and had me a nice gloat session.

A lot of programs do not require a high school diploma or GED. Did you do an entrance test or exam when you enrolled?

Ability of benefit is very subjective and it another discharge that is very difficult to qualify for. Some programs do not require a HS Dipoma or GED...off the top of my head I can think of several programs like beauty school, nurses aid and some mechanics programs that you can easily get ito without a GED.

I think I did do a test....I failed math horribly..my math is very, very bad..not even high school level, they told me I would have to take special classes if I wanted to graduate, but they never gave me the classes...course, they didn't have time...I left school due to medical reasons shortly after I started.

Thats not what the loan people told me when I filled it out the first time....I failed the test and the school told me I had to do special classes (they were supposed to do something about getting me these classes, they didn't have them themselves....I didn't even qualify for the lowest math program they had.) and the loan people knew I left the school when they offered me the discharge in the first place. :)
