SOL on student loans and credit card debts


I live in FL, and I have credit card debt and student loans which I have been actively making payments on. The credit card account has been closed for about 3 and half years now. If I just stopped making payments on both of them for 5 years, I wouldn't have to pay either of them back after the 5 years is up? What if either one tries to sue me before the 5 years is up; should I just make no recollection of the alleged debt? If they can, in fact, sue me, how does the SOL actually help? Isn't it likely they will try to sue me within 5 years?

There is no SoL on student loans.

If these debts are yours and you've been paying on them then I would recommend you continue to pay them. Student Loans can get pretty nasty as well, the first action that they might take would be to garnish your wages.

Work your budget so that you can include paying your bills as well as for the necessary things. sometimes this requires a change in lifestyle if you has suffered income loss.

You say that you have been making payments and then you say that you stoppped making payments. When was your last payment made on the cards. I am a little confused. Also I believe the SOL in Florida is 4 years on credit cards. collection agencies will lie and falsely reactivate the SOL and will sue you after ten years sometimes. Many of them buy these for pennies on the dollar and play the odds of getting paid on some, but not all of them, and will try anything. Try to pay them now! You will also mess up your credit for years to come!

Yup, no SOL on student loans. Federally backed ones will defaulted you after 9 months and charge you up to 25% in collection fees. Then they can garnish your paycheck without a court order. They seize tax returns and can even garnish social security.

Private Student loans actively sue for judgement.

Neither are dischargable in BK.
