Nebraska DFI Response to my complaint against One Click Cash


Many of you do not know me but I have been waging a war against One Click Cash since I asked them to reduce their fees to reflect my state usury laws and they responded with a threat of Fraud. One of my complaints after finding out that One Click Cash is not licensed in the State of Nebraksa. This is where they are physically located in and claim to be using the usury laws of this State. This morning, I spoke with Mr. Cameron over at the Nebraska DFI concerning my complaint against One Click Cash and he advised me that they have issued a Cease and Desist against One Click Cash and that he will be contacting individuals who have filed complaints against this company concerning repayment issues, etc. He stated that after reviewing my complaint and all the other complaints they issued the Cease and Desist but the the Company has the ability to appeal this decision. However, if they do not appeal and try to continue to lend out of Nebraska, the DFI will force the company to comply. I think this is good news. So keep filing your complaints.

I sincerely don't think you will hear from them again or that the Department of Finance will either. What address did you have for them as they are some other people on here that have had problems with them. Please post the address.

Goudah, I spoke with Mr. Cameron from the Nebraska DFI this morning and he advised me that they had just issued a cease and desist to One Click Cash. I can call him back and find out when the cease and desist was actually issued and post that here. I did not see it either when I searched. However, I don't believe they would have misstated their position, especially since I was inquiring about the complaint I filed with their division against this company. He was quite clear that due to the cease and desist order, he would be contacting all the individuals who had filed complaints against this company to advise of the status and issues of payments made, etc.

I so agree with Goudah. I guess people are realizing that enough is enough with the collection and harrassment tactics of these types of companies. So, in actuality, this helps all of those individuals who have been dealing with One Click Cash and their illegal collection tactics. I believe that is correct. I defer to Goudah if I am incorrect.

I'm not sure how much it would help people in other states, as the cease and desist order usually would only apply to those in NE . . . . But the wording says:



So maybe that could be taken to mean that they can no longer do business from NE.

Anyone in another state with a loan from them should forward a copy of this order with their complaint. I beleive they have also been ordered to cease and desist giving loans in other states too.

Goudah, I am not sure how it affects those from other states, but when I spoke with Mr. Cameron this morning he advised me that he would be contacting me in the coming weeks to discuss how much I paid towards my first loan (paid it off) and the second loan and then determine how much I am owed. I will find out more information when I speak with him tomorrow a.m.

No I am not. I am from Arizona but when I spoke with him he was aware of my complaint and advised that he would be contacting me about my loans (one previous), one current with this company. It seemed as if the Cease and Desist Order did affect my loan with One Click Cash. It could be that I filed a complaint. Who knows but I have forwarded on to the DFI of Arizona the Cease and Desist Order. Arizona law is pretty different. We don't have strong consumer protection laws and the AG's office usually refers their people to file the complaints in the states that these companies are either licensed in and/or are physically located in. The DFI of Arizona is a much better resource for consumers who deal with payday issues.

I'm not sure what it means for everyone . . . . I would suggest you call the NE DFI and ask. Also, you can find the NE DFI website at ndbf.org. Just put the www in front of it. Click on the link to file a complaint. As far as the wording on the complaint, just be honest. Tell them the situation, send in copies of any emails or other documentation you have.

Debtfreein08. Do what Goudah said in regards to filing complaints with your state AG's office, DFI and BBB. I would also file with the NE AG's office, the Nebraska BBB and the DFI of Nebraska but I would not take this company out of your dmp program as of yet. If you read the order, which Goudah a thread to the pdf version, One Click Cash has an oppoturnity to appeal the decision. So I would just continue to file my complaints and keep them on your DMP program until you hear back from the various agencies that you filed complaints with.

I just contacted NE about an e-mail offer I got from oneclick that was sent 7 days AFTER the order was issued. He wants me to send him a hard copy of this e-mail :) I will have that puppy in the mail for him today. I am also printing out other complaints I had made about them and sending them his way. I was going to file a complaint with NE but my DFI questioned the addy so I didn't. But I am now. and I am sending along all my e-mails I had with one click. I even called oneclick and ask why they sent me the e-mail after the order was issued and she wouldn't talk to me until I gave her my ss#. I told her you don't need that to answer my question. Then she went on to say well I cannot answer any questions until I look at your account. I told her don't bother because it is paid and I don't plan on taking another loan with an illegal company and that I will be forwarding the e-mail to my state DFI and to NE. SHe told me to do what I have to then "I" hung up on her.

So file complaints!!!!!!

Oh and when I talked with they guy in NE he did know I was from a different state. So the order is to stop, doesn't matter what state your in.

Yeah, I think this is different then some of the other cease and desist orders because they aren't telling them not to loan to a certain state, they are telling them they cannot do business out of that state anymore.

Usually a cease and desist order will say "X company must stop doing business with X State Residents." This one says One Click Cash must stop doing business out of the state of NE.

Yay NE! :D Take 'em down!

Sorry I have been ill and have not logged in but my understanding is the same as puddlejmpr and it is my understanding that my complaint was among the thirteen noted in the ORDER. The company was ordered to stop doing buisness out of the state of Nebraska. I have not heard from One Click Cash but when I logg onto their wesite and into my account it still has me in a collection status, even though I have not defaulted on the loan, I basically advised them that until they responded to me and resolved my issues of fees charged and threatening me with Fraud and until the DFI investigation has concluded, I revoked my authorization to debit my account. This is great news for all of us who have been victimized one way or another by the arrogance of One Click Cash. Nebraska has set the bar high as it relates to other states and how they deal with ipdl companies.

I was also the victim of One Click Cash, Also known as SFS, Inc . I did not apply for a $150.00 but yet they debited close to $300.00 from my account before I had to close the account. I have filed numerous complaints with the Nebraska Attorney General, Nebraska Dept of Banking, Federal Trade Commission, FBI and others.

Here is what I have discovered: One Click Cash ( AKA SFS, INC) is located on the Santee Sioux Nation Indian Reservation with a company address of 52956 Hwy 12, Ste #3, Niobrara NE 68760. SFS/ONE CLICK has claimed it has been incorporated by the Santee Nation Indian Tribe.

The Nebraska Dept of Banking issued a \'CEASE and DESIST ORDER\' to SFS in 2007 to cease doing business in Nebraska, but SFS thumbed their nose at the order.

In the State of Colorado (County of Denver District Court Nos 05CV 1143 and 05CV 1144, Judge Robert Hyatt) a complaint was filed by the Colorado Attorney General- Case # 07CA0582. Miami Nations Enterprises ( DBA \'Cash Advance\') and SFS ( DBA \'Preferred Cash) and now DBA \'ONECLICK CASH\', have claimed that their companies were \'tribal Entities\' and thus immune from law under the doctrine of tribal Sovereign immunity\', which basically means they are thumbing there noses at US and State laws.

The case is still on-going, and the Court has issued arrest warrants for Don Brady, chief Executive officer on Miami Nations Enterprises, and Robert Campbell, treasure of SFS. The arrest warrants have been stayed pending appeal by the MNE and SFS.

I tried to email Tribal chairman Roger Trudell @ rtrudell (@) santeedakota.org to assist me in trying to provide info on SFS, and complaining that the actions of this company that is within his jurisdiction and control were illegal and unethical, but of course he refused to answer.

Well it seems to me that you need to contact the media and get them involved in this case. The local channel 7 in omaha, ne has a special reporter that handles things like this, I believe his name is Mike McKnight, channel 7 KETV news in Omaha, NE. Contact him and see if he can offer you some assistance to this matter.

Well now, isn't that an interesting piece of information? One could get the impression that the inmates are taking over the asylum. I have said numerous times that I feel there is one big head conglomerate and all the PDLs are just a trickle down from that point. Who exactly is OZ in this scenario?

Is this the same ONE CLICK CASH in Miami, OK? I JUST finally got a PIF--no monies returned even though were ordered to.State of Ok says they can threaten them but not sue them since they claim to be on tribal nation in OK. My loans were nulled and voided by AG of Ok and now finally a PIF...wheres my money?!?

FYI SFS Inc, MTE, and their DBA of One click cash dug their own grave here. They stated that because they are a tribe that they are not governed by US law. Perfect. WE as consumers are not either. Therefore, we do not have to pay them a dime. They can come after us, call us, etc. However, they cannot touch us. Close the bank account and change your phone number and Ameriloan and One Click Cash cannot come after you. See Santee Sioux's litigation saying they were not governed by telemarketing and collections laws in OK and NB. We may not be able to take them down, but hey, they are the ones hurting themselves.
