MTE Financial can only charge you any legal fees if they are a licensed business in your state. But they have a number of complaints in most of the states and prohibited from doing business. Read this link

You need to inquire about their licensing registration and send a copy of the letter to your state attorney general. They are required to prove their business as legit before they can add further charges on your account. At this stage, you are required to pay the balance amount on the principal.

Thanks for the info...in my Revoke Authorization letter I did ask them for their WI License number, (I'm in WI) I also stated that if they didn't have a WI license, to please provide me with the states that they were licensed in, and the corresponding numbers....of course I never received any of that...I will send all the correspondence I have with them to the Attorney General in WI....I'm just wondering how to respond now, they are giving me 7 days...Maybe I'll write them another letter, saying I filed a complaint, and I will only pay them the balance on the principle, and see what they have to say to that.

Yes, mention the point and send a copy to the AG's office. In my opinion, draft a separate letter to the AG explaining the whole situation. This will help them to do any investigations on MTE Financial regarding your case

I guess they realize they don't have a leg to stand on, that's why they're trying to make a deal with me...not a very good one from my point of view....I'll think of good response to send to them tomorrow, my brain is kind of fried right now. Super busy at work. If I responded to them today, I would probably have to quote Anthony! Although that might not be a bad idea anyway! Thanks for all the advice everyone, it is very much appreciated.

teri, take the day off. Send them a reply tomorrow. Be sure to keep in mind that they are not licensed/legal. I like to keep reminding them of that, myself! And, honestly, as anthony stated, you are not LEGALLY obligated to pay them squat. The majority of people pay the principle amount back only. You do what you want to do. But considering they are way illegal and you legally don't have to give them a dime (and you can always quote anthony!), don't let them scare you/harrass you into paying more money. They are soooo notorious for this. You take out $300, they want $560. But they will FOREVER try to debit your account.

Thanks for the pep talk Cannr....I'm definately going to try to put it out of my mind until tomorrow...I'll respond to them tomorrow, when I can think straight. I will definately let everyone know what kind of response I get back from them.
Thanks again everyone for your support!

I am in WI, too, and dealing with Canr's favorite company, MTE. I know that this sounds bad, but it's almost better to wait and see if MTE will forward the account to a collection agency, they work with ARM (Accounts Receivable Management). That way you can send a debt validation letter and if ARM cannot correctly validate the debt, they cannot collect on it.

debt, that's not a "bad" thing to say! I have to laugh! Because, honestly, dealing with MTE (for most people, not all) is like banging your head against the wall. They are not reasonable. At least if they have to provide debt validation (which I find hilarious) you have a better chance with them. I just have to laugh at MTE anymore because they soooo come across as "doing business" when they are one of the most illegal of all!

No, I agree. And, ARM hasn't been trying to collect and they haven't placed anything on my credit report. I think that ARM is legal, but their client, MTE isn't, so they know that they can't do anything to collect on it. I have only gotten the contract from MTE when I asked for validation, but nothing else that is required with it. So, we'll see what happens. I'm hoping that OneClickCash doesn't foward me to collections, as they are getting their money through my dmp.

Well, ARM is owned by GE Services, which is a pretty big, legal collection agency. So, ARM is legal, it's their client that isn't, because they can't provide all of the information to legally validate the debt.
teriahosking-You can wait until they send you to collections. I would file compliants against with the BBB, and see what happens that way. It's almost better to wait until it goes to collections, and then do the debt validation letter, as MTE will not longer own the debt, they will have sold it to ARM.

I would think (and this is just my opinion) that if they were aware that their client was illegal, then this it would be illegal to try and collect a debt for them...A collection agency USUALLY would try to gather all this information before attempting to collect.

teri, you need to file your complaints NOW. You need to file with the BBB, the FTC, and your state AG. Go to www.bbb.org. You can file on line. Go to www.ftc.gov. You can file on line. Then find your state attorney general (I just googled mine). The site will come up. Under consumer protection they have a complaint form. I don't know about your state. Some you can file on line, some you have to download the form and fill it out and mail it in. It is VERY important that you file with ALL THREE of these agencies. MTE will lie to the BBB, they will then consider it "closed" saying you "refused" a settlement offer. Do not just file with them! Make sure you file, but don't just stop at the BBB. YOu need to file with the FTC and your state AG. And you need to do it now. Don't worry about a debt validation until you get turned over to collections (if ever). Trying to reason with MTE is a nightmare. File your complaints, don't sweat MTE until they contact you. Once they do, let us know what's going on. We can go from there. File your complaints now! :D

Well, I never did find where to send a complaint to the WI AG (there's a whole bunch of them) But I did file another complaint with the WI Dept of Financial Institutions. Hopefully that works...

Okay, your state is confusing! I went to check it out and it just keeps saying the Department of Finance and the Department of Justice. Okay..... how the heck to I get to the attorney general? LOL! So, you probably did the right thing by doing the complaint on the Department of Finance link. Try the other one for Department of Justice. Why not? File, file, file! :D

I couldn't find a complaint form on the DOJ site, they only gave a phone # and mailing address. I think the DFI will handle it the complaint form was a lot like the BBB and the FTC. Tomorrow is the big day when they will all try to hit my closed bank account...this could be interesting!
