CA-PDL Help Please


Hi everyone...So I am in a boatload of issues here with PDL's and I cannot stop the madness. I am even thinking of having to get a second job to pay for these things due to the "refinance" fees..

What is (if any) the recourse of the internet pdl is not licensed in CA?
The following are the pdl's, all internet:

Eastside Lenders, Cash Transfer Centers, payday loan yes, one step cash,cashcetnral.com.

Any help would be much appreciated!

PS-I did register but didnt want my name showing up...

Also, too late to close my account until after 8/31 otherwise my direct deposit will be re-routed to a paper check which takes 7 days.

I have a sole account (under my married name) and I am a co-holder on an account with my husband (maiden name)...both at the same bank. I am going to close my sole account and just use the account with my husband.

This was the most bonehead thing I have ever done...I cant believe I let myself get this deep with these pdl's. :oops:

help, jumping in for just a second! First of all, I'm posting your CA law so everyone can see. This way we're all on the "same page". NONE of your pdl's are licensed/legal. They all have charged you too much on rollover/extension fees since your state prohibits them. Whatever you borrowed (principle amount only) is what you owe. No fees/no rollovers. But, one a very important note, you need to send Cash Transfer Centers (very illegal) a letter stating that you revoke any wage assignment you may have signed with them. You need to do this ASAP. They will attempt to send a letter of wage assignment to your employer. A wage assignment is voluntary on the part of your employer. However, most employers do not know this and will give your money to these people out of your paycheck. You need to type a letter revoking this ASAP, send it to Cash Transfer Centers, give a copy to your payroll person, and keep a copy of it yourself. Do this ASAP. These are all unlicensed pdl's. And, as morningstarr posted, read about closing your account. Be cautious. Make sure any pending pdl debits will not force it back open. On a positive note, criminal action is prohibited in your state. Here's your laws for all to see. :D

Thanks for all of the help...you all are great! For the first time last night, I slept and woke up this AM knowing that I had a direction to get out of this mess. :D I know there is work to be done and I am going to stick this out until the end. Knowing I have the law on my side and you all for support helps a lot..

So, where to start.

Does anyone have a letter I can send to CTC to revoke the wage assignment?
Does anyone have a letter I can send to the pdl's to stop the drafts? I can certainly draft one citing the CA law, but if there is a successful copy out there that I can use, please share.


I am going to read the topic about closing your account too. As mentioned, I cannot take any action on my account until after 8/31 and its too late to stop the 8/31 drafts.
I will absolutely pay back the principal of these loans, but if they were not supposed to loan me more than $300, then what?

help, the letter to CTC is too easy. You need to do this NOW. All you have to do it type up a letter stating:

NAME OF PDL
ANY INFORMATION/ADDRESS/PHONE/FAX/EMAIL/WEBSITE

I hereby revoke any wage assignment I may have signed with your company, your partners, or any of your affiliates.

TYPE YOUR NAME
(Put you ss# so they can "find your file")

Plain and simple. Nothing fancy. Keep a copy, send them a copy, give a copy to your payroll. Short and sweet. Just to cover your butt if they try to pull it on you.

As for a letter, I have one, however, if you were to register, I could pm a copy to you. You are still considered a "guest", which is fine. You do not have to register if you don't want to. If you want, you can go to the "do it yourself" link at the top of this site page. Read through the letters, pick and choose from each one, and draft up your own letter. It's up to you. Just be sure you cover all the bases. Revoke their debit authorization. Revoke any wage assignments you may have signed. Inform them not to contact you via telephone, only via email or USPS only. State your state pld law. Include what you have borrowed and what you have paid. Ask for a refund if you overpaid. Ask for a PIF if you've paid the principle amount. Tell them you'll pay them xxx dollars to pay the principle amount in full. Since these are all illegal pdl's, just pay the principle amount borrowed. Do not pay the illegal fees they are charging you. Any questions, just post. :D

Be sure and deal with Cash Transfer center as soon as you can! And always keep copies of any correspondence, calls anything for your records- this has come in handy for me later, when I can pull it up and they don't think I have anything!1 Keep us posted on your progress and good Luck..KAren :D

It is absolutly not routine. Normally the pdl's will report you to Teletrack, a sub prime reporting agency. The only companies that check this report are other pdl's, and other sub prime, high interest lenders such as rent a furniture places. So in a way, it's good that you have a negative Teletrack report, because it can stop you from getting yourself into more high interest debts.

My project for this weekend is to draft the ACH revokation letters to all of my PDL's :D and have them ready to mail (certified) on tuesday HOORAY. This will be a great use of my time this long weekend and it will feel soo good. Trying to have some finesse in timing...as I will be closing my account on Tuesday also. It was too lat to stop the drafts for 8/31 so I didnt want to send the letters too early and have them go in and take more $$ out than they are supposed to.

So, I checked my account and my direct deposit went through and no pdl debits as of yet. Went to the ATM and withdrew all of the $$..then called the bank to close the account.

Okay, so now I have to come clean :oops: ....I work for a bank ( not in the branches but in the corporate side) I know...how could I work for a bank and then get into trouble with these pdl's...one word, stupid!

The account was closed immediately and I told them I couldnt open a new one for awhile...there is also a "debit block" on the account just in case and furthremore, there is no $ in it. Our bank policy will reject ACH drafts on a zero or negative balance anyhow and the account will not reopen.

volley, so you work for a bank. You think you're the only one on this forum who works for a bank? No. Do not be embarrassed. We're all human. It doesn't matter where we work. Thanks cannr..and thanks to everyone for giving me the courage to do this. :D

I was so embarrased to call to have the account closed and as I was explaining the situation, the person said "ok,so account closed w/no debits...no problem" Didnt ask me for any docs or anything. The person I talked to is in the employee directory so if there is an issue ever, I can call her (or her boss) directly.

wow....what a load off AND I now have $$ for gas/groceries, etc.

volley, you are exactly right. Now maybe you can start living like a "normal" person again! How exciting! And, I feel pretty sure you're bank won't give you any problems since you work for them! I believe you know how to remedy the situation if something arises! LOL! And, we are always here for you. Just remember that! :D

volley: I am positive that there are many people that we all know that are in some kind of financial mess, be it credit pdl's bankruptcy etc., my point is this: Just because you have a good job, intellegent, decent human being doesn't mean that sometimes things happen that seem like a good idea at the time but end up like a snowball from he##....you know where. Keep your chin up your weekend plan sounds good, although do take some time to enjoy yourself when you get your project done. Having that done will make your recreation more enjoyable!

It may be the calm before the storm, however in my past experience I notice that I would get overwhelmed by calls and then nothing from anyone for a month or more then it would start again. I don't know why but that is just the way it goes! Keep strong though and just remember they will try to intimate you and scare you but you know your rights and state laws so you will be fine!

volley, some times it takes the pdl's a while to "figure out" what's going on. It's almost as though they don't pay any attention to your letters sent. Some of them will send you "We didn't get your payment" emails. Duh. They might do this two or three times before it "clicks" in their head what's going on. Once they realize they're not receiving thier debits, they'll contact you.

I swear! I was amazed! It took some of these pdl's like two or three times of debiting and sending me "We're sorry we didn't get your payment. Has there been a mistake?" emails before it registered with them (light bulb above head!) that the account is CLOSED! Yes, I told them that! Hello! It's kind of funny. So don't be surprised. Enjoy the "silence" while it lasts. Cause soon enough, their "light bulb" is going to go off and they'll be on the phone with you! :(

This made me think of them sitting on the couch in their pj's with a light bulb over their head..the light bulb going off and shocking them awake and them picking up the phone to dial... Then it made me think of all the people who are intimidated by them..then I remembered when I was taking public speaking and they tell you to picutre the audience in their underwear..Need I say more :lol:

volley, this is just their standard "form response" when the debit is rejected. They've received your letters. They just pay no attention to them. I believe it's all just computer generated. If the debit gets kicked back, you get the standard form email (as we all have gotten). They might try a couple more times before it "clicks" that they're not getting their money. Some of them are kind of "slow" about this stuff. Ignore the email. They'll catch on eventually. Then they'll call you! :wink:
