Getting Nervous


Ok
The calls have started. Got a really nasty call from # 800 864 6033. I googled the number and it was Sims Associates. Called and got threatened, so I hung up.I dont even know which lender it was for. They refused to tell me.They wanted to scream instead.
Please let me know what to do now, I thought I was calm about all this, but apparently these places still intimadate me.

i sent via e mail a cease and desist letter. they e mailed back that it would not work and they were marking my file. They said they would call my landlord. They told me they could find him thru some type of records. They told me that they could get me on fraud charges and have me arrested. They do not have my new work number and told me if I refused to tell them where I now worked it was identity theft, that i was claiming not to be me and working under an assumed name.
Please guys keep reassuring me that they can not do anything.
Oh the person from Sims told me that they were an assest management company

They cannot do anything.

Most of us have got those threats in the past. We were never arrested. Nothing ever happened. They are hollow threats.

Think of it this way - If everyone that defaulted on a loan was put in jail, there would be a huge overcrowding problem! They would have to build a whole lot more jails!

I know- that's why I don't talk to them on the phone, I get too upset. Except now, I am pretty bold with one of them, they knwo they have broken regulations, and they know I knwo it!! They have said they see from the notes they have that I am "debt educated", I told them, it was about time!!..KAren Hang in there!! :D

I am from Ct. and have never heard of a Payday loan until I came to this site. It sounds like these are just modern day loan sharks. I was just doing some Google ???????ing??????? on this and am shocked at how many states allow such loans. I found a lot of information on this site http://www.paydayloaninfo.org/index.cfm. I don????????t know how accurate it is.

kash, please don't be upset. I remember a post by anthony not too long ago. He stated "if they were a legal collector, they would not be threatening you, screaming at you, etc." These are pdl collectors calling you. And, no, do not take their calls. Do not call them back when they leave a message. They're not going to call/find your landlord. Good God! They are insane! Actually, for as much as I've argued, emailed, and gone back and forth with my pdl's, none of them even called my "references", let alone anyone else! As far as them calling your landlord, that's uncalled for. I would re-file all my complaints (but I like to do that) and put in there that they are harrassing you with threatening phone calls. Keep documentation of everything. That's why it's best not to deal with them over the phone. Make them contact you via email or USPS. No documentation if you're on the phone. Not good. Get everything in writing. And, kash, I'm still sitting here at work..... I'm not in jail.....You'll be okay. They're full of crap and trying to scare you into giving them MORE money!

Just checked. No one called my references about me. One reference is my cousin, and she wont give any info. The other reference has changed her phone number to unlisted, so they cant contact her I am pretty safe on that front. for the longest time I ws not bothered by calls, now this Sims Associates is driving me nuts.I guess it could be worse. I have to keep believing that there is nothing that they can do to me

Anyway, Yes you are right. I should not HAVE TO BELIEVE IT, I SHOULD KNOW IT. They can not do anything to me.I guess I let them get to me, they sort of got me off guard. I am prepared for next time. I will only deal with them via e mail or usps.
Is there any way to find out if they are even allowed to collect in my state.(New York) , or does that not even matter?

Pay day lending is illegal in New York. Am I correct? Let's ask Jen and Mperez who have been battling internet pdl's. I know pdl's are illegal. However, they are having "issues" with internet pdl's. To me, they can all go straight to hell if they're not licensed to do business in your state (which they are not). Maybe I shouldn't say that. But to know that they are harrassing you and threatening you makes my blood boil. They are not even legal.

Hi Kash. Sorry for your ordeal today. I can't believe the tactics these collectors use. For one, screaming is unprofessional (not that any of these companies are professional) and for two...what is "we're going to find your landlord..." LOL! It IS like a bad mob movie. :-) Don't let them get you upset. They can't touch you. Maybe you could have a little fun on the phone with them!

from all I have read , it is illegal in New york. The
web site for New York does not give as much info , as for other states. To me it is a bit vague. What about collectors, do they have to be licensed in a particular State?

kash, do a search on this site to find a post by mperez or jen. Try to google new york or something along those lines. Posts will pop up and I can PROMISE you mperez and jen will have posted. Find their posts and pm them.

I'm here guys!

Kash, Payday lending is illegal in NY, HOWEVER, Mperez found out that if the PDL is licensed in the state that they are located in and the loan is made over the internet, then it can be considered a valid contract.

It sounds fishy to me though and I am inclined to believe that Mperez spoke to someone who wasn't really sure about the laws. To me, if they are illegal, then that's it. End of story. But, it seems that they might have this little loophole that they can go through.

Anyway, do you happen to know who it was that called you? I know some PDLs are notorious for the threatening phone calls. I believe Cashtoday is one of them. I defaulted on three so far, (all MTE) and not ONE has called me (knock wood please!). I did receive one email and that was it.

I filed with the NYS AG and they are mediating on my behalf, so we'll see how that goes.

In the meantime, please don't panic and stay strong!

I have found out the following
Its my payday is licensed in their state but there web sit does say they CAN NOT service NY. DUH
Star Advance is not licensed. Located in Costa Rica and Panama.
Fast bucks now is
ONLY licensed to do business in UTAH
United Cash loans not licensed,
I DID ALL MY LETTER SENDING AND COMPLAINTS.
i AM still trying to find out any info on one step cash and Pay Day 2 go
Those are the two I am having problems finding info on.

As fas as Simm Associates they never did get around to telling me who they were collecting for. I guess they were too busy with their threats to actually tell me anything

kash, LOL! :lol: Is St. Vincent the patron saint of pld's or something? OMG! I have never even heard of that! Is this yet another overseas one? I know I'm not too bright on the whole geography thing, but I've NEVER heard of this place! I'm dying here! Stop making me laugh at work!

Okay, I did a google map search for our patron saint of pdl's. St. Vincent is in MN, LA, AR, KY, CA, LA, and GUESS WHAT?! CANADA! I'm leaning towards this pdl being in Canada since they stated they are "governed" by St. Vincent. The ones outside the US usually put that on their contracts. Hmmm.... maybe we learned something today????

The Grenadines are a Caribbean island chain of over 600 islands in the Windward Islands. They are divided between the island nations of Saint Vincent and the Grenadines and Grenada.

That's what I found. The Patron Saint of PDL's resides on one of these 600 islands. LOL! :lol:

St. Vincent is the MAIN island! And check out the size of it! OMG! I swear, I'm going to have to write to the Prime Minister - Ralph (Ralph?) Gonsalves. Wonder what would happen if we sent him and the governor our complaints???? Oh, I'm having a field day with this one! :lol:

I guess we dont ever have to worry about Star Advance. I am certainly not planning a vacation to the sunny island of st. vincent.Well another one bites the dust. SO long Star Advance.
