I am going to put a stop payment on each of the loans


I have 5 payday internet loans. I live in Indiana..I am going to my bank and put a stop payment on each of them. I have done this before on other debits and it works well with my bank. They will try bank drafts and such but if you put the stop payment on them the bank is very good about sending them back. My loans are very small...three are just a hundred dollars. I have read that in Indiana the limit on interest charges 15% on the first 100 and no more than $20 dollars total on the next 300. However that can vary because I took out a storefront loan and they charged $37.50 on a loan of $250. and it was legal. I need help in finding out how to communicate with these people..before they bombard me calls from collection agencies.


bball, rest easy. You'll be just fine. And you will see daylight. I promise you! Since you have your bank account straight and no more debits will come out, you're going to get a lot of phone calls once these pdls realize that their debits are being rejected. Which, I personally, get a kick out of. However, they will call you. They will call you at home, at work, on your cell phone. They will bug the living crap out of you. We need to get your letters sent out. However, we first need to be sure of the amounts. This way, when you send the letters, they will be accurate. And we need contact information on the FTR one so we can send them a letter. We can send them via email/fax/and certified mail. It's going to tell them they are illegal, you revoke any debit authorization, you revoke any wage assignments, it'll have your state law, you'll tell them to only contact you via email or USPS, many, many things. However, they really don't pay attention to them. BUT it's very important to do so that you will now start to have documentation of EVERYTHING. And I do mean EVERYTHING. You do not want to speak to these people via telephone. No documentation. You want everything in writing. That's why you're going to do everything in writing. And only respond to them in writing. What you need to do now is find out whatever you can on the FTR pdl so that we have an address. Also figure out exactly what they have debited your account for. We need accurate numbers. I have a letter for you to send each pdl that covers everything. I can send it to you through pm. However, figure out the FTR pdl and the exact amounts first. We have a little bit of time here since your bank account is okay. So, find out at least an address or phone number or something on FTR and also figure out exactly the amount debited by each one of the pdls. Then we'll have all the information we need and I'll pm you the letter. You'll be fine. I'm just glad you came here.

Thank you again..I have my bank print out in front of me and I will go over it a couple more times and list them all with the dates and amounts. I can't get into my home email from work, so if I have any letters from FTR it will have to wait till I get off at 2:15am. I have been reading all the posts for the last week and a half and was amazed at how much help you all provide. Thank you so much :D

bball, are you sure about Emerald? You've got two different amounts. You borrowed 300 and paid 360? In an above post, I thought you said you found more payments to Emerald? Just let me know which one is correct. Also, do you know how to use "pm"? We can send messages back and forth to each other. Underneath my post, you will see a little button with two people on it that says "pm". Click on that button. It'll come up with a page where you can send a message directly to me. Send me a message. I'll reply to it to be sure you can retreive my messages. Then I'm going to send you a letter to use to send to these pdls. First, verify your Emerald amount for me. Then test the pm for me. If you have fax numbers, fax them. If you have email addresses, email them. Also mail them USPS certified return receipt. Send it all ways possible. Keep documentation of everything. Anything you do, you want documentation of. Everything and anything. This comes in REAL handy when filing complaints and also if they come back to haunt you months from now (and believe me, they will do this). Try not to take any phone calls from them. Do everything in writing.

I just looked up the address for Westbury Ventures with the BBB. The letter I received in August gave the address as being in Dover Delaware the zip code is 19904. Much to my surprise there are 14 collection agencies within a 10 mile radius of this zip code.
What is this the CA capitol of the world?? Interesting...most of them have a good report with the BBB..and Westbury was not listed.

OK..here we go again. Yesterday (Friday 10/12) I received a nasty phone call from a Mr. McCorkle..he stated my full name and said he had pertinent information I needed to know and I quote "you will call me back today!" Well I knew from his tone of voice it was a CA but for whom I did not know. I have all my IPDLs settle except for one which did not respond to anything I send them back in August. Which included a C&D and a letter revoking prior authorizations. I called the number he left..they answered without a hello..no company name..I asked for Mr. M...and he was busy..so I spoke with this other person who did not state his name. He pulled my account up by my cell phone number. He proceeded to tell me they represented CashAdvance.net and I owed them 260 dollars. I proceeded to tell him I paid his client in full..according to pdl laws in Indiana and his client isn't even licensed in Indiana..and I wasn't paying anymore. At this point his voice got louder and he informed me I will pay...because I took money from his client and ran! (I don't know where I ran to I've been here for thirty years) At this point he was screaming I did get louder myself and informed him he did not need to yell!
I did not understand anything he was saying so I told him if he had anything to say to me send me a letter
and do not call me again. He said they do not do things like that and they would take me to court. I said fine go to the courts in Indiana and see what you can do! I then hung up while he was still raging on... Sorry this is so long..I collected my thoughts and if anyone can suggest I do anything else...please let me know. All I have on this place is a phone number and nothing else...I guess I'll just see what happens next.

laura, the "nice man" who called you can't do squat to you. You have repaid the amount of the loan back according to your state law. You have done them a favor. You could have "taken the money and ran". He needs to shut his mouth. And, take you to court? Oh, please let me know the court date his ass shows up to collect more money from you. I do believe I will take the ride to Indiana and sit to witness that! Court. What a joke. Just go on about your life like he never even called. What a total jerk. And to scream in your ear? He's lucky you listened as long as you did. "Click" would be my response the first time he got loud with me. I refuse to talk to them. If they call, hang up. Don't even listen or try to reason with them. If they "want you bad enough", they will send you something via email or USPS.

Yes you are right cannr...I have learned enough from this forum to know what they can and can not do. In the past I would have been a nervous wreck for the rest of the day...but after that bout with that idiot..I just went about my business as if nothing happened.
In fact the more I thought about myself running away and with 200 dollars...I was laughing! Like you said I'll just wait for their letter to come in the mail..It may reveal who they are..do you think???

laura, if they "want you bad enough", they will. LOL! You might get an email or you might get something via USPS. Although they don't seem to like to use USPS very much. But if they can't you on the phone, they'll "find a way" to contact you! God love them all! I'm glad you're able to laugh about it now. It is kind of funny once you know they're full of it. Especially when anything is overpaid. They ask me for more money and I'm like "What????" :shock: You've got to be kidding me! It's a joke! Oh, okay. I've already overpaid you and now you're threatening me. Let me RUN to the nearest store to moneygram you some more money on this illegal loan. Okay.........

You know the strangest part of my attempted conversation with this person was that I felt I really intimadated him more that he did me. He seemed to be the one getting upset. Bits and pieces of his verbal tantrum seem to be coming back to me..I remember when I said they were not licensed in this state he said they were licensed in every state...yet on the CashAdvance.net website they list Indiana as one of the states they do not give loans in...why would they be licensed for a state they do not loan in??? Yeah..makes sense..doesn't it???

I know...it's about half of the United States about 22 states they do not loan in...maybe they don't check their own website. Including the stupid jerk that yelled at me telling me they are legit!
However they do have various websites under different names...and they have moved out of Delaware. My letters were returned in August and I had to fax it to them...which they probably have tossed by now.

I was checking on another name for CashAdvance.net and came across the name GR Enterprises located in Bellevue Wash. I logged-on into their state laws regarding payday loans. GR Enterprise is not listed on the licensed list of small loan lenders...however the law states that the minimun amount of a loan is 700 dollars...which is high. I checked some PDL websites listed in the state of Washington. They have the laws listed on their website and at the bottom of the page they state they will loan 1500 dollars on the first loan??? I would call that blatantly ignoring the state laws?? Or did I read the laws wrong?? Of course I have not heard of anyone getting 1500 dollars on their first loan...but I just thought it was curious.

No..these were payday loan companies website and located in Washington state. All internet pdl's list they will loan up to 1500 dollars depending on your paycheck...I just was surprised that they would list Washington's state lending laws on their website. Who knows maybe things work different in that state.

The majority of pdl websites claim "Get up to 1500 overnight". Now, do they really do that? Probably not. If they do that "depending on your paycheck", well, hell, you don't need a pdl if you're making that much darn money! I don't know about the whole posting the Washington state pdl law on their website. I just know that 99% of pdl websites claim you can get up to 1500. I don't believe it. I'm sure it's just a "lure". Then they offer you 200 or 300. Am I not correct here? How many of us have applied for a pdl that claimed we can get THOUSANDS and then get approved for 200? LOL! The majority of us, I'm sure.

I actually started that about the state of Washington looking for CashAdvance.net's address. I agree with you Cannr. I never borrowed more than 300 and the most I have heard of was borrowing 500. I don't believe they will give you that much on a regular PDL it probably has to be an installment loans. Anyway getting back to my so-called debt to CashAdvance.net. I checked my bank statements and I borrowed two loans from them the first one was in January and it was 200 the second was in June it was also 200 between the two loans I paid back 869 dollars. If that CA calls me I won't answer but if they send me a letter I will reply with a C&D and a letter stating how much I have paid their client. Then state (since they said I stole their clients money) I believe I am the victim here and their client is the theif!

I just got a call at my place of employment from emerald marketing group. I have no idea how they got my work number since I have changed jobs. A loan was taken out in my name and I didn't do it. How can I get this person to stop harrasing me?
