Help with complaints
helen
helen, all you have to do is go to www.bbb.org. You can file a complaint on line. You put in the necessary information and send! You'll receive a confirmation that the BBB received it. Then be patient. Then the BBB will respond once they receive a response from the company your complaint is on. Now, are you filing complaints on pdl's? Because, if so, the BBB is not the only agency to file with. However, if it's not a pdl, and you just want to file a complaint with the BBB, just go to www.bbb.org. :D

helen, we can probably help you here. They're all internet pdl's? If you like, you can post the following information and we can check on the pld's, your state law, etc. and help you out. You would need to post the following:
The state you reside in, who the pdl companies are, how much you borrowed (principle only), how much you have paid back.
We can probably help with figuring everything out for you and get you on the right track! Just post if you like! :D

I live in Florida. I have been reading this forum for a while and took advantage on all the tips you give. Thanks for that!. Close my account, sent letter to them revoking authorizations, talked to my Payroll Dept.
Now i think the worst part is coming now. The Calls!!!! The nasty emails!!!!!!!!! But here is a list of them:
PayDay Avenue- 500.00 and they want me to pay them 900.00

Big Int 250.00 havent paid nothing
Cash Link USA 300 and have paid 350.00
Little Loan Shoppe 400.00 and already paid 450.00

Zip Cash 300.00 and already paid 275.00

helen, you go! You are so on top of it! Have you seen your Florida laws so you know what the pdl law limits are? And, two I know of that are illegal are Eastside Lenders (they're just insane) and BIG (oh, totally illegal). CashNet I think is licensed somehow (?). But, you've already got the ball rolling! Awesome! And frogpatch is an awesome member who also resides in Florida. I'm sure he can give you some great tips! Do you know who to file your complaints with? I always tell people the BBB, the FTC, and your state AG.

I'm going to post your state pdl law for you so we can see what the state maximum allows. I've also sent a message to frogpatch letting him know just in case he has dealt with any of the pdl's you're dealing with. It's always good to get some "inside" information! However, next post we can go over the complaints to be filed....
You will find the Payday loan laws for Florida here (just select your state),

Thanks for all your help to me and to everybody with my situation. This people lie to us, and we in a desperate situation. Im a single mother with 3 girls, belive in them. I will be doing all i have to do to to totally prohibit this .

helen, I'm certainly no expert at deciphering laws; however, I can tell you that no rollovers/extensions are permitted in Florida. Also, you're supposed to have a 24 hour "cooling off" period in between borrowing loans. So these pdl's aren't abiding by your state laws with respect to those two things anyway. I'm going to check and see if I can find them listed as licensed in Florida. Frogpatch is better with Florida, but hang on and I'll check and see what I can find!

The only one there that is licensed in the state of Florida is Cash Net USA. The rest of them are not. The State usury laws put a 10% cap on payday loans with a small application fee allowed. These laws wre upheld in the Supreme Court of the State of Florida in a case called Wendy Betts v. Fast Funding. Along with the agencies referred to by Cannr you should also fil complaints with the Florida Dept of Financial Services. You can find the at www.fldfs.com
You have already taken the right steps to get this under control. BIG Int is the worst of them. They are illegal and based out of the UK. They will say anything to try to scare you. The fact of the matter is they can't legally do anything to you as they are not licensed in this country. Do not talk to them at all. Pay them back the principal plus 10 percent as a moral obligation and at your own pace by mail. Eastside is a blister also. Try to get all there addresses and revoke there ACH priveledges. Write to them and tell them they are to contact you by mail only. If you put there names in the BBB website you should be able to get an address for most of them. Florida is a non garishment state and also forbids wage assignments. You have the upper hand now. The first thing to do is get them off the phone and into the mail box. Cashnet even though they are licensed seems to ignore all forms of communication including certifed letters. They will eventually send you a settlement but it will take them a while. If you don't take the settlement they will start calling again even though you sent them a letter not to. That is when you file another complaint for harassment. They will then start send lower settlements. They send them to me but they are already expired by the time I get them.

Now, I'm not showing these coming up under Florida. However, don't take my word for it. I'm sure frogpatch will come around and he will know for sure. We can figure out then (once we know if they're licensed/unlicensed) what you technically owe on each one. Hang in there. frog should be around soon since I sent him a message!

Goudah, forgive my ignorance! Whats a CSO? In Florida it means combined sewer overflow. In other places Community Service Officer. Or Chief Security Officer

frog, your a riot! I'm so glad you rescued helen! frog to the rescue! And, of course, goudah too! helen, if you need any more help or have questions, please post. As you can see, there are others in the same situation and the same state you reside in that will have wonderful information for you! We are all here to help! :)

Oh, I'm so sorry to hear that. I'm not surprised, but I am sorry. They are notorious for being ruthless. If they call again, do not take the calls - if you get around it. Dealing with them on the phone is just downright crazy. If you happen to get them on the phone, tell them to only contact you via email or USPS. Then hang up. Don't even try to reason with them.

CSO means Credit Service Organization. It pretty much means that the "business" helps you find a loan, with the purpose being to "improve" your credit. It's like you apply at the CSO, and they go looking for the loan, sort of like vouching for you, so that you can get a loan even though you have bad credit. It sounds like a good idea on the surface, but with pdl's modeling their business this way it's sick and wrong. To piggyback under a law meant to help consumers with credit? They are doing nothing but helping to ruin further that persons credit!
Rollovers/Extensions
I have been dealing w/CashNet USA for a little while, and have been receiving extensions when I needed them, until last week, they told me they are not allowed to issue anymore ext.due to a NEW LAW,apparently the payday loan laws DO APPLY TO THEM!!
