I have a payday loan with a company called upfrontmoney.com.I had a payment due of $145 on 07/31/2007. I contacted the company and told them I would not have the money and I asked them to not withdraw it and to make alternative arrangements. They agreed to this. On 07/27/2007 they withdrew the money anyway so I did a stop payment on the charge through my checking account at Old National. On 08/02/2007 I had about $250 in my checking account. Upfrontmoney.com withdrew $725 from my account via my debit card which I don't know how they had access to. Even though I did not have this much in my account Old National approved the transaction and I was in the negative and two weeks away from being paid again. I called customer service at Old National and explained the situation. I was told to call upfrontmoney.com first and then call back. I did this and they said it was out of their hands and my bank would have to stop the debit. I called Old National at the 1-800-731-2265 number and the sales rep called me a liar, she said I owed the money and she would not file a dispute because we would not win. She said she would look into this and call me back. She called back 4 hours later and said she had called upfrontmoney.com and I was a liar and I owed them the money and if I was overdrawn it was too bad. I explained that I needed to do something as I have a daughter to feed and I wouldn't be paid again for two weeks. She responded by saying it wasn't her problem and that I owed the money and they took it. She said she would file a dispute because I requested it but we had no chance to win and she was not happy about having to do it. She added that I would be charged $33 for several NSF items due to this. She was very demeaning and ridiculed me throughout this process. I would have at least appreciated some help in finding a solution and being treated with at least a small amount of respect other than the treatment I received. Now I'm in the negative and I won't be paid for two weeks. I never authorized this company to take the money out. Is there any recourse at all? Does anybody know if they can legally do this after I've requested in writing and verbally that they not debit my account?


I would think it is very illegal to perform the kind of transactions that they performed. First of all, they withdrew 4 days prior to the date it was supposed to be withdrawn and then they turn around and withdraw over 2X the amount they were supposed to withdraw. Also, they used your visa card without your permission. To me, they have committed some major infractions. I can't believe your bank isn't backing you up. It seems that they could get into trouble over this, as well. Thanks for warning everyone about them. I don't think they know how much the bad publicity can hurt them. I hope you get this resolved. I know how it is trying to make ends meet for a long stretch of time without any money. Good luck.

I would try working with the bank in person first but if you don't get any satisfaction there I would definetly elevate it to your State Banking regulators.
Some of the threads I've read here just amaze me. It makes you wonder with the kind of customer service these places practice, how do they ever stay in business?
