McCarthy Burgess and Wolff: Is it a collection agency?
I ran internet ads with the talking phone book about a year ago.
I ran internet ads with the talking phone book about a year ago. On the contract it said I could cancel the contract with a 15 day written notification. Which I did. Sent it in e-mail form, the rep responded meaning she got it. Done.. right? All my ads were pre-paid. Nope, the talking phone book kept running my ads and charging me. Now Mccarthy Burgess and Wolfe are calling saying I owe an obscene amount of money. They are assholes on the phone, Actually, one guy was nice.. but this other guy is silly mean. Which is fine with me.. he's not an attorney, so I don't care. I sent them the cancellation info, and they are still trying to hit me up. Sooo... they tried to get me to settle for $5000... hah! $5000 when I don't owe $1. I am going to keep playing this out becuase I have all the evidence in my corner and it's starting to get fun. I may start reading doctor seuss books to them when they call.

I had the same problem as tvanhoose. I signed the contract for 3 months trial running flyers. I called the customer service to cancel the contract. They told me that I can not cancel and I have to call the sale guy. I called him and he did not answer his phone. I left him several messages and no respond. Then I faxed my cancellation request to him and certified letter to their office. They did not respond to my letter except asking for money. It started with 2k, now increase up to 10K. I kept a copy of the contract and I a copy of my certified letter to them. I am ready to see them in court. I just make a copy of my cancellation letter to them, if they send me the bill.
The Law Needs to Change
I have never dealt with a more disgusting company in my entire life. Gary Rose is a moron to the 10th degree. The problem is, if it is debt used for business purposes, it is not covered under the FDCA. This needs to change!!! I'm know we're not the only small business owners who lost everything only to be ridiculed and told the bankruptcy is a "choice" that deadbeats make. Maybe if all of us got together, the law could be amended to include business debts. There's no logical reason to allow debt collectors to be unregulated in their behavior when collecting non-consumer debt. It's a disgrace.
If you are a sole proprietor then you are personally liable for
If you are a sole proprietor then you are personally liable for the debt, therefore the debt is covered under the FDCA. We are being pursued by them for a debt involving an equipment lease and I currently have a file over two inches thick of the emails, phone calls, letters, etc... I've yet to receive any form of debt validation from them (they forged a letter claiming it was from the oc...unsigned, no letterhead, etc)...who do they think they are fooling?...lol
respond quickly
When dealing with this McCarthy Burgess and Wolff clan you need to be quick and proactive. I have found that this outfit has employees that give out fake names and the names on their mailings are of people that don not exist.
Respond to their phone calls in writing and mention the names of individuals you have spoke with or recieved mailings from. They really dont know what to do or how to respond after that.

It's been awhile, but they called me back today (see my first response above) They called trying to collect on a debt that the talking phone book created for themselves by not canceling their agreement as pertaining to their contract. So they called back and acted like it was the first time they had talked to me and said again that this was the final notice before they sent it to the client for further action. My response has been the same every time. Bring it on. I have written proof of everything. There is nothing they can do if it goes to court. My thoughts have to be this. The talking phone book knows they won't get me to pay it because it honestly isn't my fault. I think they are trying to get me to pay a settlement using scare tactics. Not working. They won't take me to court. I beg them.

File a BBB complaint. It forces them to defend their position. I've had several false accusations of owing them ficticious money. Every time I filed with the bbb the claim was mysteriously dropped.

They have resorted to calling using local phone numbers, but the return call number is in Ohio. Very sneaky. Again, they do not disclose when you speak to them the source of the debt. I see mention of a DV letter can someone tell me what that is and where I could find a template to guide me?

keep reading these posts someone wrote all the answers for you. you must write them a letter asking them what the money is owed for, explain and show how they calculated what they say you owe. show copies of any papers that show I agreed to pay what you say I owe. Finding that forum will make you very happy
Do not pay a dime! Report to bbb and washington dc

If it is not a legitimate debt, then she needs to request validation of this alleged debt. She also needs to keep everything documented, so if she does go to court she can proved she attempted to resolve this issue before it went that far. Also it's good to have documentation of fdcpa violations, if any, so she can sue them if needed. Believe me, and I'm speaking from personal experience on this, burying your head in the sand will not make them go away. And I'm sure a few others on this forum will agree with me on that. |
Forget what this turk says! DO NOT PAY the crooks. Call BBB and they'll tell you who to report them to in WASHINGTON DC
answer to post 773356
please do not leave these crooks scare you! Call the BBB and they will give you a number and name of someone in WASHINGTON D.C. to report to. Believe me these people along with VERIZON are in BIG trouble.

THIS PERSON IS GIVING THE RIGHT INFO.Call BBB report it to them they'll give you a phone # of someone in WASHINGTON D.C. to call. Happy Days!!!
Scam
They have been leaving messages on my company cell for a month now without asking for a specific person. Recently they started asking for my name. I picked up their call today and they said I owe them $700 for Medianet (?). I have no idea what this is. I asked them to send me the bill. They said they sent multiple notices, which they did not. Fortunately, I checked them out online prior to this conversation and knew it was a scam. I asked them what was my last name. The guy said he did not know my last name. How can you try to collect from someone with only first name?! I also have the same phone # and adress for past 7 years, which they have no record of. If I owe anyone any money, they should have at least my last name!
It is definately a scam!

I am likewise having problems with these folks. Is anyone interested in joining in an action against them? Please let me know.
You should sue them
They are a Collection Agency and they are trying to sue me because I opened my own company, and now they want to sue me for Non compete. any dirt you know about them let me know.
I called them back and told them "Every time you &%(%(^ call me
I called them back and told them "Every time you &%(%(^ call me I am going to call you ten times. I am dead serious. So take me off of your calling list." I was told it is not a calling list, this is important""If it is important then a ()*&^%(&^ person would be calling me, not a God &*^$* machine Then I called them back 10 times and left the phone on so that they would have to hang up on me. Supposedly they have taken me off of their calling list. Now lets find out if it's true.

I work for a company who is being stalked by them.! Last weeke i was told that i was personally on the hook for the charges. I called and asked for a letter from them showing that i am not responsible for this debit. dont expect to see it.......... how can they do this?
Answer It
They have an automated system that calls. I did call back once. Some BS about a debt that I didn't actually owe, with the claim that there was a $25 balance owed to them. For $25, if it were legit, I'd have paid 'em, but since it's not, I'm not about to encourage that kind of thing.
So... answer it? We do answer it. Now THEY need to have someone on the phone, if it's so very important.
Pay your bills
How about you go F yourself? What if, imagine this, you DID pay your bills and some jerk is just trying to harass you and wrangle some undeserved money from you? How about you take that smug, self-rightous BS and a hike instead?

They are also claiming to be a law group. My suggestion don't answer your phone. Screen your calls.
They are a Zombie debt collection agency. I didn't even know I owed Verizon anything since I told verizon to send my last bill to the new address and they did and I paid the last bill they sent me.
McCarthy, Burgess and Wolf Lawyers? Not
:confused:yes, I want to sue them. They have been calling my business on behalf of verizon. I'm not calling them since it's long distance and they never have a real person call me. I don't even know what I owe them for and I returned a phone and they never refunded my money of over $100.00. They have been harrassing me every single day> I guess they figure that if they keep calling two or three times a day I will call that long distance number. I will not ever call them. Verizon has all my pertinent information and they've never once sent me a bill, so what's up with that. My understanding is that they can sue your business but not you personally. McCarthy Burgess and Wolff claim to be a law group. I don't believe it for one minute.
I have sent numerous letters to verizon and not once have they responded. I've even sent certified letters and I know they got it and still they never respond. I'm not working with a company that can't even give me the time of day to figure out what is going on.

Wow what a scummy company!! It was Kenneth Murry that i spoke with family affair i guess! lmao Im sending them a letter, telling them i will in the event they continue to call me I will not only seek damages but will have them charged them with harrasment and any other criminal acts that they are commiting in the event they dont stop.
send them registared keep a copy and a copy to your local district Attorney
its not right
Cee U Next Tuesday from this company
I've had this company calling many times and the b*tch that I keep talking to has the worse attitude. This last phone call from them today, I was trying to give her my company's attorney information and she spurts off that she is tired of deadbeats like my boss not paying their bills. She has piss poor attitiude (name is Mikaela Mason) and really needs to either get herself a man or some new batteries. Company is totally not professional.
By the way, we had been paying the company we owe directly and they should no longer be involved, but she won't stop calling.
credit report
so i'm pretty much in the same boat as a lot of you, had a nasty bill from AT&T yellow pages that was over promised and under delivered.
just started getting calls from these guys with just a Mr. whatever leaving me messages, nothing nasty yet, just a call back number.
my question for you guys above is have you noticed any marks or changes to your credit report(s) from this company or the parent company (ie at&t, verizon, talking yellow pages, etc...)
i can deal with the nasty calls, but i'm really worried about my credit report. i'm a sole prop so anything from my business hits me directly.
(btw, i've owed the debt to at&t now for a little over a year, nothing on my credit report from them)
thanks all!
